Not long ago, the punishment of a Taoist priest in Sichuan sounded the alarm for all Taoists. If there is only a pass certificate or a scarf certificate, or a teaching certificate, if you teach acupuncture and moxibustion in a Taoist temple, you may be identified as practicing medicine illegally, even if there is no charge and no external service. Many Taoists are confused: the Ten Paths and Nine Physicians, inherited from Taoism, why is it illegal? The core answer is that acupuncture and moxibustion is a medical act, which can never be touched without a medical qualification certificate. So, how should Taoists legally practice medicine? According to Article 99 of the Basic Medical and Health Promotion Law, if an unlicensed practitioner forfeits medical equipment, and there are no illegal gains, the illegal gains will be calculated at 10000 yuan. In this case, the illegal gains will be calculated at 10000 yuan and a fine of five times the amount will be imposed, which is the minimum standard of 50000 yuan. Article 39 of the Physician Law: Non physicians practicing medicine may be fined up to 100000 yuan; Those who cause damage shall bear corresponding criminal responsibility. The key determination is to look at behavior rather than identity. The transmission certificate cannot be equated with the physician certificate. Mutual reinforcement between master and apprentice does not necessarily equate to teaching. As long as needles are administered, a medical certificate is required. How to obtain legal medical qualifications? According to the current medical laws and regulations in our country, there are three ways: one is to have expertise, which is stipulated in Article 11 of the Physician Law, to have studied under a master for at least 3 years and to take the "Master Apprentice Certificate" exam; Intern for one year and take the assistant physician exam, register for five years and take the practicing physician exam. The second type is the newly established expertise in traditional Chinese medicine. According to Article 15 of the Chinese Medicine Law, the content of the qualification examination for traditional Chinese medicine physicians should reflect the characteristics of traditional Chinese medicine. Individuals who have studied traditional Chinese medicine through apprenticeship or have practiced for many years and have expertise in medical skills can obtain the qualification of traditional Chinese medicine physician by being recommended by at least two traditional Chinese medicine physicians and passing the practical skills and effectiveness assessment organized by the competent department of traditional Chinese medicine of the provincial, autonomous region, or municipality directly under the Central Government; So, with only the professional qualification certificate of a specialist physician, you can open a clinic or medical institution for home visits within the scope of the physician you have obtained. Third, it is suitable for young Taoists. They can directly obtain the qualification of assistant doctor or licensed doctor after graduation by taking a college degree or above in Chinese medicine or acupuncture and moxibustion and massage. Remember: Religious sites are not equivalent to medical institutions, and inheritance cannot replace qualifications. It is necessary to obtain a certificate before practicing to avoid violating the law. (Looking into the New Era)
