Revision of the Implementation Rules of the Hong Kong National Security Law to Assist in Enhancing the Special Administrative Region's Ability to Maintain National Security

On the 23rd, the Information Services Department of the Hong Kong Special Administrative Region Government announced that the "Implementation Rules for the Revised Implementation of Article 43 of the Law of the People's Republic of China on the Safeguarding of National Security in the Hong Kong Special Administrative Region in 2026" (hereinafter referred to as the "Revised Rules") were published in the constitution and came into effect on the same day. The revised rules are based on the accumulated experience of the Hong Kong Special Administrative Region in safeguarding national security, formulated by the Chief Executive of the Hong Kong Special Administrative Region in conjunction with the Hong Kong Special Administrative Region Committee for Safeguarding National Security (hereinafter referred to as the "NSC"), and will help enhance the ability of the Hong Kong Special Administrative Region to continuously safeguard national security. Article 43 of the Hong Kong National Security Law stipulates various measures that law enforcement agencies of the Hong Kong Special Administrative Region may take when handling criminal cases that endanger national security, and authorizes the Chief Executive of the Hong Kong Special Administrative Region to formulate relevant implementation rules in conjunction with the Hong Kong National Security Commission. According to relevant regulations, the Hong Kong Special Administrative Region has a constitutional responsibility to continuously improve the legal system and enforcement mechanism for safeguarding national security, in order to effectively prevent, stop, and punish behaviors and activities that endanger national security. The Implementation Rules for Article 43 of the Law of the Hong Kong Special Administrative Region of the People's Republic of China on Safeguarding National Security, jointly formulated by the Chief Executive of the Special Administrative Region and the National Security Commission, came into effect on July 7, 2020. The Hong Kong Special Administrative Region has gained practical and operational experience in handling cases of crimes endangering national security and implementing the Implementation Rules over the years. Based on these experiences and relevant court cases, the Chief Executive of the Hong Kong Special Administrative Region, in conjunction with the National Security Commission, will formulate the "Revised Rules" to improve the measures that law enforcement agencies in the Hong Kong Special Administrative Region can take and further clarify relevant legal procedures and technical arrangements, in order to further strengthen the law enforcement capabilities of law enforcement agencies, more effectively prevent and investigate crimes that endanger national security, and timely prevent and resolve national security risks. A spokesperson for the Hong Kong Special Administrative Region government stated that the formulation of the revised regulations is in compliance with the Basic Law, including provisions related to human rights, as well as relevant provisions of the Hong Kong National Security Law. The provisions in the "Revised Rules" are rigorous and specify the powers that relevant law enforcement agencies may exercise under what circumstances; The various measures in the "Revised Rules" have mechanisms for judicial oversight to ensure that law enforcement personnel can effectively prevent, stop, and punish acts and activities that endanger national security when implementing various measures, while also fully protecting the legitimate rights of individuals and organizations in accordance with the requirements of Article 4 and Article 5 of the Hong Kong National Security Law.
