Among them, there were 1536 cases related to ordinary food, 351 cases related to health food, and 174 cases related to drugs, accounting for 74.5%, 17.0%, and 8.5% respectively; Cases of online consumption of health food and drugs have a higher level of public attention due to their direct impact on consumers' lives and health. Currently, with the deep integration of digital economy and e-commerce, online consumption has become an important channel for the circulation of food and medicine. According to data, the scale of food e-commerce transactions in China will continue to climb from 2.4 trillion yuan to 3.3 trillion yuan from 2023 to 2025. At the same time, problems such as false advertising, illegal sales, and counterfeit goods in the field of online consumption of food and drugs have emerged, which directly affect the health and safety of the people. It is not only a highly concerned issue in society, but also an important livelihood issue that the people are eager for. According to Yi Jun, a member of the Party Leadership Group and Vice President of the Beijing Internet Court, who reported at the meeting, the Beijing Internet Court found that disputes involving the elderly were on the rise year by year through the analysis of online food and drug consumption cases heard in the past three years, especially in the field of health food and drug consumption. In addition, there are also a certain number of "occupational claims" in food and drug online consumption cases. This type of entity does not purchase food and drugs based on their own consumption needs, but deliberately seeks out food and drugs with label defects, inappropriate promotional content, and other issues on the internet. After purchasing in bulk, they file a lawsuit and claim punitive damages to obtain economic benefits. According to Yi Jun's introduction, from the judgment results, about 65% of cases fully or partially support consumer litigation requests. In the above-mentioned supported cases, the vast majority of cases supported the consumer's lawsuit request for a refund of the purchase price, with about 40% of cases sentencing the relevant sellers and producers to bear punitive damages. In cases where punitive damages are imposed, the sellers are often individuals or individual businesses. Compared to enterprises above a certain scale, such operators often lack professional knowledge and personnel in food and drug safety. They do not have a comprehensive understanding of food and drug safety laws and regulations, labeling standards, advertising boundaries, and other requirements.
