This year's CCTV "3.15 Evening Gala" exposed a hidden AI "poisoning" industry chain: customers only need to pay corresponding fees to GEO (Generative Engine Optimization) service providers, and their products can be "listed" in mainstream AI models, and their product advertisements can even directly become the "standard answer" given by AI. And these so-called 'standard answers' are likely to be filled with a lot of false information. In recent years, artificial intelligence technology has developed rapidly, bringing many conveniences to people's production and life. However, the double-edged sword effect of technology has also become prominent. As the public gradually becomes accustomed to seeking "optimal solutions" and authoritative references from AI, some unscrupulous merchants take advantage and build a complete closed loop of "software supply content generation data feeding ranking manipulation". They fabricate product efficacy, mass produce massive amounts of false soft articles, induce AI algorithms to capture and prioritize display, and disguise commercial promotion as authoritative 'factual conclusions'. During this process, the AI big model was unknowingly "poisoned" and became a tool for illegal merchants to seek illegal benefits. From a legal perspective, this behavior of brainwashing AI and manipulating its output results is not "grey marketing", but an illegal act that crosses the legal red line. Its essence is to use technological means to carry out false advertising, which seriously violates laws and regulations such as the Advertising Law, Anti Unfair Competition Law, and Consumer Rights Protection Law. The existence of this industry chain not only infringes on consumer rights and disrupts market order, but also undermines public trust in AI technology and hinders the healthy development of the AI industry. Therefore, precise measures and heavy handed rectification are necessary. The proliferation of the chaos of AI "poisoning" is not only due to the temporary disconnect between legal supervision and technological development, but also reflects the weak legal awareness and profit oriented mentality of some market entities. To eradicate this chaos, it is urgent to establish a pluralistic governance system. Regulatory authorities should accelerate the improvement of relevant laws and regulations, clarify the regulatory requirements for the entire lifecycle of AI data, and crack down on AI "poisoning" behaviors that are exposed; AI operators should fulfill their main responsibilities, strictly verify the source of language materials, establish traceability mechanisms, and build the first line of defense against false information; Consumers should also improve their discernment ability, be alert to suspicious recommendations given by AI, report problems in a timely manner, and create a good atmosphere of public supervision. The development of technology cannot be separated from the protection of the rule of law, and the growth of AI towards goodness requires rules and constraints. There is no distinction between good and evil in technology itself, the key lies in whether users adhere to legal bottom lines and business ethics. Only by legally cutting off the industry chain that poisons AI and safeguarding the clear AI industry ecosystem can technological progress truly serve economic and social development, and help continuously improve public welfare.
