Representative members suggest placing orders based on demand to accelerate the cultivation of high-quality foreign-related legal talents

Currently, China's high-level opening-up to the outside world is advancing in depth, and the construction of foreign-related rule of law has become the core support for safeguarding national sovereignty, security, and development interests, participating in global governance system reform, and responding to complex external environments. During the National People's Congress and Chinese People's Political Consultative Conference, accelerating the cultivation of high-quality foreign-related legal talents with firm political stance, understanding of international rules, proficiency in practical operations, and a global perspective has become one of the hot topics of discussion among the attending representatives and members. Mei Bing, a representative of the National People's Congress and Secretary of the Party Committee of East China Normal University, pointed out that at present, there are problems in the cultivation of foreign-related legal talents in universities, such as lagging knowledge, "disconnection between learning and application", gap between students' "understanding of rules" and "practical ability", and mismatch between graduates' "single skills" and "composite needs", which make it difficult to quickly adapt to the requirements of front-line foreign-related legal practice work. This is more concentrated in practical teaching and training mechanisms. Yang Zongke, a representative of the National People's Congress, Vice Chairman of the Teaching Guidance Committee for Law Majors in Higher Education Institutions of the Ministry of Education, and Deputy Director of the Standing Committee of the Xi'an Municipal People's Congress in Shaanxi Province, believes that currently, there are still a few universities in China that can regularly organize students to participate in international law simulation court and international criminal court simulation court competitions. The coverage of most students entering international organizations, overseas law firms, and arbitration institutions for internship practice needs to be expanded. The cultivation of an international perspective requires both 'bringing in' and 'going out' efforts, but in reality, students' exposure and experience in the forefront of international legal services are far from enough, "said Yang Zongke. Zhang Yi, a member of the National Committee of the Chinese People's Political Consultative Conference and senior partner of King&Wood Mallesons, pointed out that the training systems of some universities still lean towards "supply orientation" and fail to fully meet the "demand orientation" of the market. At the same time, as a secondary discipline, international law needs to be enriched in terms of professional segmentation and curriculum system construction. In addition, most university teachers have limited international practical experience, and multiple factors combine to affect the matching degree between the output of foreign-related legal talents and market demand. Mei Bing, based on research, pointed out that in recent years, many universities have increased their reform efforts to promote the faster and more accurate connection between the cultivation of foreign-related legal talents and the actual needs of the industry. Based on their own disciplines, resources, regions, and other characteristics, they have built a demand oriented, industry education integrated full chain (recruitment and training, etc.), multi-dimensional (academic and non academic) training system. However, how to solve the problem of homogenization in the training of foreign-related legal talents is still a concern for the interviewed representatives and members. Focusing on the characteristics of the location and enhancing the brand of education is an important breakthrough. It is reported that East China Normal University relies on the construction of the "Five Centers" in Shanghai and the integrated development location of the Yangtze River Delta, with the "Shanghai University Foreign related Legal Talent Education and Training Base" and "Enterprise Compliance Research Center" as the core carriers, to create differentiated talent training characteristics; Based on the characteristics of regional development, some universities such as Northwest University of Political Science and Law closely follow the core needs of China Central Asia foreign-related legal services and cross-border dispute resolution, and connect with the needs of regional foreign-related legal development. In response to the mismatch between talent cultivation in universities and market service demand, "order based" training has become a breakthrough strategy. Yang Zongke suggested that foreign-related legal talents can be subdivided into three categories: foreign-related legal services, foreign-related legislation and law enforcement, and international organization legal talents. A hierarchical and gradual three-level training goal should be established, and a dynamic monitoring mechanism for talent demand should be established to promote the focus of department affiliated universities on cultivating international organization legal talents. Local universities should accurately connect with regional open foreign-related legal needs, clarify the training positioning of various colleges and universities, and fundamentally solve the problem of talent supply and demand mismatch. Empowering with digital intelligence technology has become an innovative direction for improving the accuracy and quality of talent cultivation. At present, more and more universities are integrating cutting-edge content such as AI legal document intelligent writing, cross-border compliance intelligent review, and international case big data analysis into their teaching systems, strengthening students' practical abilities through digital means, and promoting talent cultivation to closely follow the trend of digitalization and intelligence in the field of foreign-related rule of law. Several representatives and members of the committee believe that the cultivation of high-quality foreign-related legal talents is a long-term and strategic systematic project, and it is urgent to build a full chain support system that integrates school local, school enterprise, and inter school cooperation to comprehensively fill the gaps in training. Yang Zongke emphasized that school enterprise collaboration needs to transform from single internship docking to full process co education. Universities cannot only use enterprises as internship receiving units, but should work together with practical departments to develop training programs, core courses, and carry out joint education. Encourage foreign-related law firms, multinational enterprises, and international organizations to jointly build normalized practice bases, so that students can hone their practical abilities in real foreign-related legal projects. Mei Bing called for the establishment of a two-way communication channel between the practical and academic fields, thoroughly solving the problem of disconnection between learning and application. He suggested that real cases from the front line of foreign affairs, the latest international rules, and cutting-edge cross-border compliance issues be fully integrated into classroom teaching, abandoning the traditional mode of pure theoretical indoctrination; Intensify support for the construction of national and regional foreign-related legal training bases, and establish standardized and normalized practice platforms; Smooth the channels for talent transfer to international organizations, establish a long-term mechanism for talent promotion between universities and international organizations, and help more outstanding foreign-related legal talents participate in global legal governance. Zhang Yi put forward the following suggestions from the perspective of faculty and talent resource allocation: on the one hand, vigorously introduce senior legal experts and foreign-related practical backbones from overseas, create a dual teacher teaching team with solid theoretical foundation and rich practical experience, promote the two-way rotation of university teachers and foreign-related practical department personnel, and fill the gaps in faculty practical experience; On the other hand, we will dynamically update the national database of foreign-related lawyers and the directory of foreign-related legal talents, achieve on-demand and precise allocation of talent resources, and revitalize the existing stock of foreign-related legal talents.
