In recent years, the system of administrative law enforcement supervision has been continuously improved and its efficiency has been continuously enhanced. At the same time, phenomena such as arbitrary charges, fines, inspections, and seizures still occur in administrative law enforcement, and problems such as illegal law enforcement in different places and profit driven law enforcement still exist. The supervision of administrative law enforcement needs to further improve mechanisms, standardize procedures, and strengthen responsibilities. It is urgent to strengthen administrative law enforcement supervision through legislation. "The relevant person in charge of the Ministry of Justice stated that the" Regulations on Administrative Law Enforcement Supervision "(hereinafter referred to as the" Regulations ") will come into effect on February 1, which is conducive to further optimizing the business environment and better playing the important role of administrative law enforcement supervision in comprehensively improving the level of law based administration and strengthening the construction of a rule of law government. In April 2025, the administrative law enforcement supervision bureau of a certain city in Shandong Province conducted a case review and found that the comprehensive administrative law enforcement bureau of a county-level city had imposed administrative penalties on a certain type of business operation department outside the city, which was suspected of violating regulations by enforcing laws in other places. Due to the fact that the case involves communication and contact with higher-level departments in relevant fields and other relevant departments in the city, the Administrative Law Enforcement Supervision Bureau of the municipal government has decided to upgrade supervision in accordance with the law. The law enforcement actions in this case not only violate the jurisdiction regulations, but may also trigger chain problems such as "selective law enforcement" and "repeated punishment", which will increase the burden on the enterprise. After verification, the administrative law enforcement supervision bureau of the city government requested the comprehensive administrative law enforcement bureau to conduct in-depth investigation and rectification of such problems, and transfer the problem clues to the discipline inspection and supervision commission for further processing. The special action to standardize administrative law enforcement related to enterprises carried out nationwide since 2025 has not only effectively rectified prominent issues in law enforcement related to enterprises, but also promoted the promulgation of the Regulations. The Regulation adheres to the principle of the rule of law for the people and fully safeguards the legitimate rights and interests of enterprises and the people. ”Professor Wang Jingbo from Heilongjiang University stated that in order to ensure the connection with the relevant provisions of the Private Economy Promotion Law and protect the legitimate rights and interests of enterprises, the "Regulations" stipulate that administrative law enforcement supervision agencies shall timely analyze and judge the clues of administrative law enforcement issues reflected through channels such as the enterprise related administrative law enforcement appeal communication mechanism and the government service convenience hotline, and determine key supervision items. According to the Regulations, administrative law enforcement supervision agencies may invite representatives of the National People's Congress, members of the Chinese People's Political Consultative Conference, industry representatives, experts and scholars, journalists, etc. to participate in administrative law enforcement supervision activities as needed. The Regulations have shown the determination of private entrepreneurs to build a rule of law government, and have also strengthened our confidence in operating with peace of mind and letting go of development. Recently, Jiang Yuhai, the chairman of the Xianju Chamber of Commerce in Ningbo, Zhejiang Province, was appointed as one of the first batch of specially invited administrative law enforcement supervisors by the Ministry of Justice. He stated that he will timely and objectively reflect problems and jointly promote the construction of a rule of law business environment. Administrative law enforcement supervision is a re supervision of the law enforcement supervision of administrative law enforcement departments. To truly "grow teeth" and achieve practical results, efforts must be made in the authority and execution of supervision. Meanwhile, administrative law enforcement supervision cannot replace or monopolize law enforcement.
