In recent years, under the scientific guidance of Xi Jinping's thought rule of law, Chinese courts, based on the reality of China's large-scale governance, have launched a top-down and bottom-up combination of judicial digital revolution, formed an advanced concept, complete system and efficient operation of the Internet judiciary "Chinese model". In practice, what impact has the "Chinese model" of Internet justice brought to's rule of law and global governance? How should it develop in the future? This column is specially invited by the School of Foreign Languages of Northwest University of Political Science and, Dean and Professor Chen He to write a signed article, please pay attention.
Chen He, Dean of the School of Foreign Languages and a professor at Northwest University of Political Science and Law, said the world is experiencing changes of a magnitude not seen in a century. The digital economy is profoundly reshaping the global competitive landscape and poses unprecedented challenges to judicial systems across countries. Issues like the exponential increase in the number of cases, the high cost of litigation, and the uneven distribution of judicial resources are increasingly becoming global obstacles to achieving universal justice. In this historic test, China's courts, under the guidance of Xi Jinping's thought on rule of law, and with the top-level design and overall promotion of the Supreme People's Court, have demonstrated tremendous political courage and reform wisdom, and carried out the most extensive, profound and influential internet judicial innovation practice in the history of human justice successfully.
This model not only greatly enhances the level of building a country ruled by law, a government under the rule of law, and a society ruled law in China, but also contributes Chinese wisdom to the civilization of world law with its advanced nature, systematicness, and effectiveness, and provides a solid judicial public product for building community with a shared future for mankind. The formation of the "Chinese Model" of internet justice is not accidental, but the inevitable result of the combined action and resonance of theoretical, practical logic, and technological logic. Under the scientific guidance of Xi Jinping's thought of rule of law, Chinese courts, based on the reality of China's largescale governance, have launched a revolution of judicial digitalization combining top-down and bottom-up approaches. From the "spark" of establishing the world's first internet court inzhou in 2017, to the "blaze" of digital court construction covering the whole country and throughout the whole process today, China has made a huge leap from and drawing lessons to innovation and leadership in just a few years, forming an advanced, systematic, and efficient "Chinese Model" of internet justice. This model is a concentrated reflection of socialist rule of law with Chinese characteristics in the judicial field, and is also a successful practice of Xi Jinping's thought of rule of law in the digital age.
The scientific underpinning of Xi Jinping's thought on rule of law is the fundamental guarantee., “Adhere to the leadership of the Party” ensures the internet judicial construction always moves in the right political direction, forms a national strategy layout of moving forward as one, and departmental constraints and resource internal friction. Second, “Adhere to the people-centered principle” defines the fundamental purpose of the construction. All technical applications and rules design revolve “Efforts should be made to ensure that the people feel fairness and justice in every judicial case”, and how to make it easier for the public to resolve disputes, more to file lawsuits, and justiciable. Online mediation, mobile micro-courts and other innovations are all the digital manifestation of the judicial concept of serving the people. Finally “Persist in reform and innovation” provides strong motivation. Xi Jinping's thought on rule of law encourages the integration of modern technology into judicial reform, promotes the in- transformation of the judicial system and working mechanism, and clears the ideological obstacles for the integration of technology and justice. The wisdom of governing a large country is the inherent driving. China has the largest number of cases in the world, and the long-standing contradiction between more cases and fewer judges directly promotes the revolution of efficiency. At the same time, is vast, and there are great differences in development among the eastern, central and western regions. The online litigation model can effectively overcome geographical obstacles and enable the masses in remote areas to the same quality of judicial services as those in central cities. Also, the “Fengqiao Experience”, which has been developing for more than half a century and is still, is also revitalized in the digital era, preventing and resolving a large number of disputes at the grass-roots level, and realizing the innovation of social governance models. The precedent of Digital China is an external condition. China's thriving digital economy and strong digital infrastructure provide world-leading technical support and application scenarios for internet justice. The maturity of5G, artificial intelligence, blockchain and other technologies has made the online and intelligent judicial process a reality from the blueprints. The connection between the judicial system and other digital government systems data sharing and business collaboration, and forms a virtuous cycle of “Digital enabling governance”. The “China Model” of internet justice is a three-dimensional and multi- systematic project, and its characteristics can be deconstructed into four dimensions that support each other. First is the organizational system, where specialized courts coexist with the fully online process. has adopted a strategy of combining “key breakthroughs” with “comprehensive development”. On the one hand, Hangzhou, Beijing and Guangzhou internet intermediate courts are established “experimental fields” and “vanguard teams” to centrally hear new types of internet cases, explore and formulate network space governance rules. On the other hand, the online model is vigorously promoted in all courts nationwide, and the online trial is extended to various types of cases, achieving a unique organizational form of dual-track and integrated development of “” and “offline”.
Second is the system of rules, which moves from technical application to institutional innovation. The success of China' internet justice is key to achieving a leap from "instrumental application" to "institutional innovation". The Supreme People's Court has formulated the "Rules for Online Lit of the People's Court", "Rules for Online Mediation of the People's Court" and "Rules for Online Operation of the People's Court", which the first time established the legal validity, basic principles and applicable rules of online litigation in a comprehensive way in the world, created new systems such as "out-of-sych" and "electronic service", and marked the basic establishment of the framework of the judicial procedure system in cyberspace. Third is the system of technology, whichowers justice and efficiency with intelligence. China has built the world's leading intelligent trial technology support system. The intelligent auxiliary case handling system can conduct case analysis, evidence verification, generation and similar case push, and has become the "intelligent assistant" of judges. Blockchain technology is widely used in electronic evidence preservation, ensuring the authenticity and unalterability online evidence. The judicial big data management and service platform has realized the real-time monitoring, scientific analysis and effective management of case information of people's courts nationwide, and provided data support for judicial decision-making and national governance. Fourth is the system of values, which aims at achieving "digital justice" as the ultimate goal. Behind all technologies rules is a distinct value pursuit. China's internet justice not only seeks "efficient justice", but also "quality justice". The "China Model" has greatly promoted theification of judicial standards and the improvement of judicial credibility through the full judicial openness and the case database of the people's courts. By reducing the cost of litigation and simplifying litigation process, it has greatly enhanced the people's sense of access to justice. It has achieved a unity of higher levels of fairness, justice, more accessible judicial efficiency and better experience, and is a vivid interpretation of the concept of "digital justice". While the effectiveness of the "Chinese Model" of internet justice provides a solid support for the integrated of a country ruled by law, a government ruled by law and a society ruled by law, it is also an innovative exploration of Chinese wisdom that provides a systematic and referential solution the global reform of judicial digitalization. First of all, it is a foundational contribution at the domestic level. For the construction of a country ruled by law, the "China" has greatly promoted the modernization of the trial system and trial capacity, so that the judiciary can better perform its duties as the last line of defense for maintaining social fairness and. For the construction of a government ruled by law, the online administration of administrative litigation helps the administrative organs to improve their digital governance level and their ability to administer according to law and speeds up the pace of building a "digital government". For the construction of a society ruled by law, it cultivates the whole society's habit of finding law in of trouble, solving problems with law and resolving conflicts with law, especially among the younger generation, and promotes the formation of a digital social governance ecology.
Second is the contribution to the global level of sharing. The "Chinese Model" provides a "judicial infrastructure solution. For many developing countries eager to improve judicial efficiency but facing funding and technological bottlenecks, China's mature online litigation system solution provides a low-cost, high-efficiencyfrog development path, and provides accessible "judicial public goods" for building a community with a shared future for mankind and practicing global governance initiatives. The Chinese courts have formed series of pioneering judicial rules in the trial of cutting-edge cases involving big data rights, algorithm discrimination, platform monopoly, virtual property, etc. This "local wisdom" derived from practice is providing a precious "Chinese plan" for exploring the governance rules of the global digital space. The systematic and pioneering achievements of the "Chinese Model" in the field of digitalization need to be transformed into real and extensive international influence, and a set of communication strategies and progressive paths that combine strategic height and operational accuracy must be established. In the process external communication, the principle of openness, inclusiveness, mutual learning and mutual reference should be adhered to. Focusing on the issue of judicial modernization that the whole mankind is concerned about, we should focus on highlighting the value concepts such as "digital justice" and "justice for the people", which not only reflect Chinese characteristics, but also have international appeal and consensus foundation. By integrating these concepts into specific cases, institutional achievements and cooperation initiatives, we can enhance the persuasion and affinity of China's rule of law narrative and guide the international community to understand and recognize the achievements of China's rule of law construction from the perspective of common values. It is necessary to systematically select Chinese judicial cases milestone significance in the global frontier fields such as data rights, platform responsibility, algorithm governance, and digital finance. By refining their judicial rules and legal logic, the cases behind the times and humanistic care are presented in vivid storytelling and visualized ways. With these typical cases as the carrier, transcending the differences of legal domain and culture, effectively breaking the prejudice, and clearly showing the forward-looking concept, professional spirit and innovative wisdom adhered to by Chinese justice in response to the common challenges of the digital era. On the of consolidating the mechanism-based platforms such as the World Internet Conference, the World Internet Legal Forum, and the "Belt and Road" Legal Service International Forum, we should expand the international mainstream emerging media and social platforms such as TikTok, YouTube, X(Twitter), etc., to set issues, share achievements, and guide discussions in more vivid and intuitive audio-visual form that fits the information acquisition habits of international audiences, especially young groups, to achieve effective touch and deep integration of China's rule of law in the global public opinion field.
To deepen exchanges and cooperation with judicial teams from the global South through systematic, institutionalized high-level judicial training programs, organize in-depth inspections and practical experiences of China's innovative practices in digital courts and internet justice, influence and cultivate a group of judicial elite forces that deeply understand the path of China's rule of law development, have professional quality and are friendly to China, and make them a bridge and bond for mutual learning between Chinese and foreign judiciaries. It is necessary to promote the upgrading of communication, from exporting specific technical products to exporting rules, standards and concepts; from sporadic exchanges of experience to deepening substantive cooperation projects such as establishing an online dispute resolution mechanism for the Belt and Road Initiative; from passively responding to international concerns to actively setting global issues such as the "ethics of artificial intelligence judicial application", and grasping the initiative of voice. The "Chinese model" of internet justice is a ripe fruit of Xi Jinping's thought of rule of law in the digital age, and a reflection of the superiority of the socialist rule of law with Chinese characteristics. It was born in China and serves the world. We should take an open, inclusive, and cooperative attitude to promote international dissemination, share with the world the wisdom and experience of Chinese justice, jointly respond to judicial challenges in the global digital age, and make new and greater contributions to promoting construction of a more just, efficient, and inclusive human destiny community.
