Who is responsible for accidentally getting injured while playing "Escape Room"?

"Escape Room" has become a popular entertainment method among young people, attracting a large number of young players. However, how should legal responsibility be divided if injured in a 'escape room'? Recently, the People's Court of Xinye County, Henan Province, concluded a dispute case caused by injuries sustained during a "escape room" event, sounding an alarm for entertainment venue operators, managers, and young people who are passionate about escape room games. On the evening of July 17, 2025, Wang experienced the "escape" game in the secret room operated by the defendant Li. Before entering, both parties signed a written notice of safety precautions, but did not provide protective equipment. After entering the room, in an extremely dim environment, Wang was injured when his left foot violently hit the wall while running to avoid being chased by NPCs. Afterwards, although the operator accompanied Wang for initial treatment, there was a disagreement between the two sides on the issue of subsequent compensation, and negotiations reached a deadlock. Wang then sued the defendant in Xinye Court, demanding compensation for medical expenses, nursing expenses, lost work expenses and other related costs caused by the injury, totaling 20484.4 yuan. The judge believes that the core of this case lies in whether the operator has fulfilled its legal obligation to ensure safety. In this case, the secret room environment (extremely dark) and interactive mode (chasing) themselves have certain risks. The operator did not fully alert the risks, did not provide necessary protective tools and measures, and delayed emergency response after the consumer was injured, failing to fully fulfill their safety protection obligations. At the same time, consumers also have a necessary duty of care for their own safety when participating in such activities. Based on the comprehensive case, the court ultimately determined that both the plaintiff and defendant were at fault in this incident. On the basis of establishing facts and clarifying responsibilities, the presiding judge actively organizes communication between both parties. On the one hand, explain to the operator the main responsibility and legal consequences of the security guarantee they should bear; On the other hand, guide consumers to rationally view their own duty of care. After patient and meticulous mediation by the judge, both parties finally reached a consensus on mutual understanding and compromise: the defendant operator shall compensate the plaintiff Wang for a total of 11000 yuan in medical expenses, nursing fees, lost wages and other related expenses on the spot. The compensation shall be paid in court. The judge's statement: Whether to "fulfill the obligation of security protection" should be comprehensively considered. In recent years, emerging immersive real-life games such as "escape rooms" have become popular in the market, and they are widely sought after and loved by young people due to their characteristics of intelligence, challenge, and interactivity. Although these entertainment venues have fulfilled their safety obligations by informing players of the game items and precautions on the online ticket sales page and before entering the venue, there are still problems such as not providing necessary protective equipment, dim venue lighting, and not informing players of special dangerous terrain inside the venue, which have led to frequent accidents in escape room games. Article 1198 of the Civil Code of the People's Republic of China stipulates that operators, managers, or organizers of public places such as hotels, shopping malls, banks, stations, airports, sports venues, entertainment venues, etc. who fail to fulfill their safety protection obligations and cause harm to others shall bear tort liability. If the actions of a third party cause harm to others, the third party shall bear the liability for infringement; If the operator, manager, or organizer fails to fulfill their security obligations, they shall bear corresponding supplementary responsibilities. After assuming supplementary responsibilities, operators, managers, or organizers may seek compensation from third parties. According to the above regulations, operators and managers of escape room games should fulfill their security obligations in the game. If the operator or manager fails to fulfill their security obligations and the player is injured in the escape room game, the game operator or manager will bear corresponding tort liability, including apology and compensation for losses. For whether operators and managers have fulfilled their safety obligations, consideration should be given to whether the staff's explanations and prompts of the secret room before the game starts are in place, whether warning signs are set up for dangerous areas, whether the facilities and equipment comply with safety regulations, and whether the staff receive regular safety training. At the same time, employees playing NPCs should pay attention to players' reactions and avoid any behavior that may cause players to overreact during interactions with them. Therefore, operators and managers of games such as escape rooms should strengthen safety management and training, reasonably adjust venue lighting, equip necessary safety protection facilities and tools, install warning signs in dangerous areas, ensure the safety of game facilities and the rationality of game design, and provide players with a safe and enjoyable gaming experience. At the same time, when participating in games such as escape rooms, players should choose legitimate venues, check fire permits, fully understand the game content and safety tips, and be cautious of heart disease and high blood pressure patients entering horror themes.
