Tighten the "safety valve" of live streaming e-commerce food

Recently, the State Administration for Market Regulation issued the "Regulations on the Supervision and Management of the Implementation of Main Responsibility for Food Safety by Live E-commerce Operators" (hereinafter referred to as the "Regulations"), which make provisions on regulating business behavior, strengthening regulatory measures, and refining punishment standards, comprehensively consolidating the responsibilities of various relevant entities such as live streaming e-commerce platform operators, live streaming room operators, anchors, and service institutions. In recent years, live streaming e-commerce has become an important channel for food consumption due to its strong interactivity and wide dissemination. However, at the same time, chaos such as false advertising, selling expired food, impersonating special food with ordinary food, and inducing over-the-counter transactions have also occurred frequently. Especially for some elderly consumers with relatively weak discernment ability, they are easily misled into purchasing "problematic food", but later fall into the dilemma of no way to return and difficult rights protection. Behind these chaos, there are some factors that contribute to the lack of platform responsibility - loopholes in audit management, which often use the excuse of "inability to control" to shirk responsibility; This is also due to the diversity of live streaming e-commerce entities, vague definition of responsibilities, and insufficient targeted regulatory measures. The existing institutional regulations are difficult to achieve effective supervision throughout the entire chain. Therefore, the practical significance of introducing specialized regulations and strengthening responsibility constraints is self-evident. The Regulation includes platform, live broadcast room operators, broadcasters, and service providers in the regulatory scope, achieving full coverage of responsibilities. Among them, the main responsibility of the platform is particularly emphasized, requiring it to establish institutional measures such as review and registration, training, and risk control, establish a working mechanism of "intelligent monitoring, investigation and dispatch, and rapid disposal", and open convenient complaint channels to promptly handle consumer demands. It can be said that as an important carrier of live streaming e-commerce activities, the platform is a key link in food safety risk prevention and control. It must be fully responsible for the "people" and "goods" in the live streaming room, strictly implement regulatory "prescribed actions", and effectively build the "first line of defense" for food safety in the live streaming room. At the same time, the "Regulations" emphasize that "self-produced and self sold" require corresponding qualifications, and "pure sales" must strictly control product selection and eliminate ambiguous areas of responsibility for different forms of live streaming. In addition, 13 types of live streaming rooms are explicitly prohibited from selling food, 10 prohibitions on live streaming behaviors are refined, and efforts are strengthened to deal with illegal activities. These measures closely align with the communication characteristics of live streaming e-commerce, providing clear guidance and strong support for regulating industry business behavior and strengthening full chain supervision, responding to consumers' concerns about food safety, and better protecting consumers' legitimate rights and interests. The live streaming room is not a lawless place, and there has never been any "flexible space" for food safety. Only by tightening and tightening the "safety valve", making the platform responsible, practitioners strictly abide by norms, and precise supervision can we build a safer online food consumption environment for consumers. This is not only an inevitable requirement for safeguarding the legitimate rights and interests of consumers, but also a necessary path for the live streaming e-commerce industry to dispel false fire and achieve healthy development.
