The reporter recently learned from the State Administration for Market Regulation that the "Measures for Handling Complaints and Reports in Market Supervision and Administration" have been revised and released recently, and will come into effect on April 15, 2026. The measures aim to improve the quality and efficiency of handling complaints and reports, clarify the regulation of malicious claims, and improve the complaint jurisdiction of operators within the platform. The relevant person in charge of the Enforcement and Inspection Bureau of the State Administration for Market Regulation introduced that in recent years, there has been an increase in the abuse of the complaint and reporting system. A small number of people are using the name of "cracking down on counterfeits" to engage in "false accusations", and some even use illegal methods such as smuggling, package switching, and fraud to extort or defraud compensation from operators, which damages the business environment, disrupts market order, makes merchants unable to bear the disturbance, and also squeezes consumer rights protection resources. In order to regulate malicious claims and prevent institutional abuse, new regulations have been added that the right to complain and report shall not be abused to seek improper benefits. Complainants shall provide their true identity information and corresponding factual basis. Those who provide false materials, use others' names, or refuse to cooperate in verifying their true identity information shall not be accepted. It is reported that according to the original regulations, complaints against operators within the platform shall be handled by the county-level market supervision department of their actual place of operation or the domicile of the platform operator. In recent years, consumer complaints in the e-commerce field have become a key and difficult point for consumer rights protection. Some online stores have inaccurate identity information, inadequate platform identity verification and dispute resolution assistance, jurisdictional disputes between platforms and online stores, and difficulty in determining the "actual place of operation" have led to difficulties in tracing disputes and implementing responsibilities. In this regard, the measures have further improved the complaint jurisdiction of operators within the platform, replacing "actual operating location" with "publicly disclosed address", which helps to unify standards and provide clearer guidance for consumer rights protection and market supervision departments to determine jurisdiction. If the address is not publicly disclosed or the publicly disclosed address is false, the market supervision department in the location of the platform will supervise the platform to fulfill its legal obligations.
