Upon learning that Lao Yan was about to undergo surgery to remove steel plates from his lower jaw and knee, prosecutors from the Dianbai District Prosecutor's Office in Maoming City, Guangdong Province finally felt relieved. One day in October 2022, Lao Yan collided with a tractor driven in the same direction as Li while riding a two wheeled motorcycle carrying a passenger. The accident resulted in fractures of Lao Yan's knee and mandible, as well as burns on his legs. According to the accident assessment, both parties shall bear equal responsibility. After treatment, Lao Yan lost more than 25% of his left knee joint function and was assessed as Grade 10 disability; After internal fixation surgery for mandibular fracture, there is a degree I restriction on the mouth opening, which is assessed as Grade 10 disability. After the accident, Lao Yan filed a civil lawsuit and the court ruled that Li should compensate him for economic losses of 129000 yuan. However, during the treatment of Lao Yan, Li only advanced 2000 yuan for medical expenses and did not pay any further fees. In October 2023, Lao Yan applied to the court for compulsory enforcement. The court ruled to terminate the execution procedure as there is no property under Li's name that can be executed. In order to treat their illness, the Lao Yan family not only exhausted all their savings, but also carried a heavy external debt, and their lives fell into difficulties. Due to the inability to afford the high medical expenses, Lao Yan can only rest at home. Multiple steel plates in his lower jaw and knees cannot be removed for a long time, and his calves are showing signs of muscle atrophy. In April 2025, the Supreme People's Procuratorate deployed supervision activities related to the termination of civil execution procedures. The case of Lao Yan's application for compulsory execution was handed over to the Dianbai District Procuratorate of Maoming City as a supervisory clue. The hospital quickly established a dedicated team and actively carried out investigation and verification work. After retrieving the court's execution case file, the prosecutor found that there was indeed no property under Li's name that could be executed. It was him who hit me, and I am not at fault. The 2000 yuan advanced should not have been given... Anyway, I will not pay any compensation and have no money to compensate. You can do whatever you want! ”When the prosecutor investigated and verified the situation with Li, his attitude was extremely tough. There is no property available for execution under the name of the executed person, and we can focus on checking whether he has engaged in hiding or transferring property. ”The deputy prosecutor of the court, Liang Wulin, provided guidance to the case handling team. Subsequently, the investigation team went to relevant functional departments and major banks to retrieve information such as bank statements and consumption records of Li and his spouse. After careful screening and comparison, the prosecutor found that there were assets under the name of Li's spouse that could be executed, and Li's family also renovated a three-and-a-half-story villa. In view of the above situation, the court recommends in accordance with the law that the court resume the case execution procedure. After the court resumed the execution procedure, the prosecutor and the executing judge found Li together, patiently explained the law and reasoning based on the evidence obtained, and elaborated on the interests involved. However, Li still refused to cooperate. In the end, the court took judicial detention measures against him in accordance with the law. When Li arrived at the entrance of the detention center, his psychological defense line collapsed and he offered to pay compensation. On October 10th, after consultation, Lao Yan and Li reached an execution settlement. Lao Yan voluntarily made concessions and agreed to accept a compensation amount of 95000 yuan. Li paid a compensation of 40000 yuan to Lao Yan on the spot and promised to settle the remaining debt in full within one month. Considering the financial difficulties of the Lao Yan family, the Dianbai District Procuratorate assisted them in applying for judicial assistance. On October 30th, Li's relatives transferred the remaining 55000 yuan compensation to Lao Yan. Thus, this three-year dispute has come to an end. As of now, the application for disability and low-income subsidies for Lao Yan is also steadily progressing, and judicial assistance funds will be disbursed in accordance with relevant regulations and laws. With these guarantees, the follow-up treatment costs for Lao Yan have basically been reduced. He followed the doctor's advice and will arrange surgery in the near future to remove steel plates from his lower jaw and knee. (New Society)
