10 evaluation teams conducted in-depth evaluations of 222 cases in various regions. The national procuratorial organs' criminal cases appeared in court to support the public prosecution evaluation activities. Observation: "Now the court session is open! ”The hammer has fallen, and in August of this year, a case of duty related crime is being tried in the People's Court of Chengbei District, Xining City, Qinghai Province. The members of the Ninth Evaluation Group of the Supreme People's Procuratorate listened attentively throughout the entire process. During the trial, the prosecutor used multimedia to clearly display the chain of evidence and effectively respond to defense opinions. The defendant ultimately pleaded guilty and repented. After the trial, the feedback from the evaluation team was positive, with more precise suggestions for "pointing points". Fully accept! "The relevant person in charge of Qinghai Provincial Procuratorate stated that they will comprehensively transform the evaluation opinions into specific measures to enhance the public prosecution capacity. This systematic review began in April of this year, when the Supreme People's Procuratorate deployed for the first time the nationwide criminal case court support for public prosecution review activity. Ten evaluation teams were dispatched to various parts of the country, serving as "quality inspectors," "coaches," "researchers," and "promoters." In just six months, they evaluated 222 cases and achieved the expected goal of "discovering problems, summarizing experience, improving abilities, and promoting work. Taking this opportunity of appearing in court to support the evaluation of public prosecution, procuratorial organs in various regions are promoting the continuous improvement of the ability of prosecutors in the new era to appear in court to support public prosecution. With the comprehensive and objective application of the leniency system for confession and punishment, the overall environment for criminal cases to be prosecuted in court has undergone profound changes. On the one hand, in most cases, due to the defendant's confession and punishment, the adversarial nature of the trial is weakened, and the pressure on prosecutors to appear in court is correspondingly reduced, which to some extent affects the continuous improvement of the prosecution's ability; On the other hand, although the number is small, the intensity of courtroom confrontation and the difficulty of appearing in court for new difficult and complex cases with significant impact far exceed the past. In addition, in the Internet era, the trial of major cases needs to face the social supervision, and the professional development of the defense lawyer team has further intensified the confrontation in the trial. To address these challenges, the 2024 National Conference on Criminal Prosecution Work of Procuratorial Organs explicitly proposed to focus on the substantive trial and vigorously strengthen the work of public prosecution in court. In this context, the Criminal Prosecution Work Guidance Group of the Supreme People's Procuratorate has decided to organize and carry out nationwide activities to support the public prosecution evaluation of criminal cases in court. This event is led by the Department of Major Crimes of the Supreme People's Procuratorate, and jointly participated by four other criminal prosecution departments. Ten evaluation groups are selected from the national procuratorial organs to form a team of talented individuals. The evaluation activity focuses on selecting major difficult and complex cases, covering five types: ordinary crimes, major crimes, job-related crimes, economic crimes, and juvenile prosecution. In addition to attending court sessions according to the plan, each evaluation group also adopts a "door-to-door hearing" method, randomly selecting expedited and simplified cases for evaluation to ensure comprehensive and objective evaluation. Supervisors should actively accept supervision. Since the launch of the criminal case court support for public prosecution evaluation activity by the national procuratorial organs, a total of 275 people's congress deputies and CPPCC members at all levels have been invited to participate. Li Ziwei, a representative of the National People's Congress and a teacher at the Liaoyang Special Education School in Liaoning Province, who was invited to participate in the court evaluation work, stated that the prosecutor stands in court and accepts scrutiny from various sectors of society such as National People's Congress representatives, CPPCC members, and people's supervisors, providing the most direct window for the public to understand and support the inspection work. As a lawyer who has been engaged in criminal defense for a long time, I deeply understand that the positive interaction between prosecution and defense is crucial for judicial fairness. ”Shen Teng, a member of the Beijing Municipal Committee of the Chinese People's Political Consultative Conference and director of Beijing Shuaihe Law Firm, said that during the evaluation activity, he was invited to observe the trial of an intentional injury case handled by the Second Branch of the Beijing People's Procuratorate. During the trial, he truly felt the good atmosphere of "confrontation rather than confrontation". The prosecutor insists on using facts as the basis and laws as the criterion, giving the defense sufficient space for cross examination and debate, and allowing the trial to efficiently focus on core disputes. In his opinion, appearing in court to support the public prosecution evaluation activities can not only help prosecutors identify shortcomings and improve their public prosecution capabilities, but also force lawyers to enhance their professional competence. On April 16th, during the trial of Li Mouhong's theft case at the People's Court of Tianfu New Area in Sichuan Province, the prosecutor's series of questions regarding the details of virtual currency transfer opened the prelude to the nationwide prosecutorial support for public prosecution evaluation activities. The 10th evaluation group of the Supreme People's Procuratorate listened to the entire process, marking the official launch of the "grand review" of public prosecution capabilities covering multiple regions. During the event, the professional performance of prosecutors from various regions in the face of complex trial situations was showcased in a concentrated manner. One of the charms of a trial is its uncertainty, as prosecutors may encounter many unexpected situations, which greatly tests their ability level. ”Hou Huimin, a member of the Second Evaluation Group of the Supreme People's Procuratorate, a national outstanding prosecutor, and the director of the Major Crime Prosecution Department of the People's Procuratorate of Cixi City, Zhejiang Province, stated that this first nationwide trial to support the public prosecution evaluation activity is a "comprehensive examination" of the ability of prosecutors to appear in court to accuse crimes in practice. The members of the evaluation team strictly follow the requirements of the Supreme People's Procuratorate, conduct case by case evaluation, ensure close connection between evaluation and trial, timely review all aspects of the trial, not only discover good experiences, but also accurately capture the problems that the prosecutor encountered during the trial. In the new era and new journey, the way prosecutors present evidence in court to support public prosecution is also keeping up with the times. Most of the evaluated cases adopt multimedia evidence presentation methods, converting various types of evidence such as documentary evidence, physical evidence, and electronic data into digital forms such as images, videos, and 3D models, and presenting them in a three-dimensional manner in court, making the presentation of evidence in complex cases clearer and more intuitive. In the robbery case of Pan Mouhong handled by the First Branch of the Shanghai People's Procuratorate and the intentional homicide case of Liu Mouhui handled by the Ningbo People's Procuratorate in Zhejiang Province, the prosecutor used 3D models to dynamically display the defendant's route of entering the crime scene, helping judges and observers quickly understand the scene structure. In addition, in many new and difficult criminal cases, expert witnesses, investigators, and appraisers appear in court to testify, fully explain and discuss the key issues, and help the procuratorial organs effectively accuse the crime. The growth of excellent prosecutors cannot be separated from the "mentoring" of senior prosecutors. In the process of supporting the public prosecution evaluation activities in court, it is not uncommon to see the personnel configuration of the "old leading the new" public prosecution team - in the bribery case of Wang, who appeared in court to support the public prosecution at the People's Procuratorate of Daqing City, Heilongjiang Province, Zhao Qian, the prosecutor general of the court, led the youngest prosecutor of the court to appear in court to support the public prosecution; Chen Ping, Deputy Prosecutor General of the Pudong New Area People's Procuratorate in Shanghai, led the handling of the counterfeit registered trademark case involving Huang and Wang by forming a team of "excellent prosecutors+senior prosecutors+young assistants". Prior to the trial, the division of labor between the main and auxiliary personnel was clearly defined, and cooperation was strengthened during the trial to effectively prosecute the crime. Excellent prosecutors are 'fed' out of cases. Encouraging young prosecutors and prosecutor assistants to participate in the handling of difficult and complex cases and appear in court for public prosecution can help them grow rapidly. ”Ren Jie, a member of the Tenth Evaluation Group of the Supreme People's Procuratorate, one of the top ten prosecutors in China, and a senior prosecutor at the fourth level of the People's Procuratorate of Wuhu City, Anhui Province, said. With the deepening of the evaluation activities, more and more evaluators have felt the practical significance of the evaluation activities, such as "mutual benefit between teaching and learning", "insightful comments from the evaluation group", "not only pointing out the crux of the problem, but also providing 'good solutions'". Pu Jingyi, the prosecutor appearing in court and a senior prosecutor at the fourth level of the Major Crime Prosecution Department of the Chengdu People's Procuratorate, told the reporter of the Rule of Law Daily that the opinions put forward by the evaluation team are specific and practical, and can be applied to daily work. In her notebook, she recorded in detail the suggestions given by the members of the evaluation team: "You can use questioning or inquiry to determine the meaning of the secret language in the fixed technical investigation" "Set closed questions for confession retraction to avoid getting entangled in details"... Not only the evaluated personnel benefited, but also the members of the evaluation team broadened their horizons. Evaluation is not only a process of assessing the performance of others, but also an opportunity for us to learn from each other, "Song Kai, a member of the fifth evaluation group of the Supreme People's Procuratorate, one of the top ten prosecutors in China, and a senior prosecutor at the fourth level of the first branch of the Tianjin Procuratorate, told reporters. The members of the evaluation group are frank about the problems with the prosecutor's performance in court and will reflect on whether they also have similar problems. At the same time, when I see other people's good practices in handling cases, I will also carefully record them and apply them to future court support and prosecution work. On November 12th, the Supreme People's Procuratorate held a summary meeting on the activity of criminal cases appearing in court to support public prosecution evaluation by the national procuratorial organs. The meeting clarified that the Supreme People's Procuratorate will promote the transition from phased activities to normalized work in supporting public prosecution evaluation activities in court, and require provincial and municipal procuratorial organs to gradually achieve full coverage of all court evaluation personnel in their respective jurisdictions. Time sets questions, practical answers are given. The criminal prosecution departments of the national procuratorial organs will transform the results of the evaluation activities into a strong driving force for promoting the high-quality development of criminal prosecution work, and take this evaluation activity as an opportunity to continuously improve their ability to support public prosecution in court.
