The use of AI technology to create an "internet celebrity storefront" at food delivery stalls cannot become an illegal profit-making tool

The "AI illusion" cannot bring traffic. Recently, news about food delivery stalls using AI technology to package "boutique dine in restaurants" has attracted attention. Someone went to explore the store and found that the actual scene was vastly different from the promotional pictures. After the truth was exposed, the relevant businesses were widely criticized, and many consumers said they would never order meals from this restaurant again. It can be seen that using AI technology to create the illusion of an "internet celebrity facade" cannot become an internet celebrity, nor can it bring traffic. With the development of technology, AI generated content is becoming increasingly realistic. If misused, abused, or maliciously used, it can pose significant security risks. Some netizens roast that "looking at a picture now also needs to consider the authenticity", while others believed that "malicious use of AI will become an accomplice in false propaganda". These voices convey public concerns about the misuse of technology. In commercial promotion, it is understandable to use technological means to package products and services, but the prerequisite is legality and compliance. Firstly, the content should be truthful and legal, and must not contain false, deceptive, or misleading information to consumers. It must truthfully reflect the actual situation of the goods or services; Secondly, merchants should clearly and distinctly label the quality, price, and other details of their products or services. For platform stores using AI generated content, it is necessary to strictly follow the provisions of the "Artificial Intelligence Generated Composite Content Identification Method", and add explicit and implicit identification to AI generated text, audio, images, videos, and other content. These labels cannot be added arbitrarily, and their font size, pace, duration, etc. must comply with mandatory national standards. If commercial promotion crosses the compliance red line and abuses AI generated content, it may infringe on consumers' right to know and even constitute consumer fraud. The Consumer Rights Protection Law stipulates that consumers have the right to know the true situation of their purchase, use of goods or receipt of services. To some extent, if businesses use AI generated content that does not match the actual situation, even if they attract customers temporarily, it will be difficult for them to develop in the long run. Technology should be used for good and cannot become a tool for illegal profit. In recent years, there have been relevant judicial rulings clarifying rules and boundaries on how to standardize the application of artificial intelligence technology. For example, in the country's first "AI Companion Case", the Beijing Internet Court made it clear that the creation and use of a virtual image of a natural person without permission using AI technology constituted an infringement of the right to name, portrait and other personal rights of a natural person. This indicates that no matter how science and technology develop, the protection of basic human rights is always the bottom line. Currently, there is an urgent need to further standardize the use of AI generated content in commercial activities. On the one hand, businesses should operate with integrity, effectively meet consumers' right to know, and use technology to improve the quality of products or services. If AI is used to generate content for storefront purposes, it should also proactively label it according to regulations to protect consumers' right to know. On the other hand, platforms should strengthen supervision, urge the replacement of untrue or non compliant images, make good use of customer evaluation mechanisms, and fulfill their "gatekeeper" responsibilities. Relevant departments need to improve regulatory methods that are compatible with technological development, formulate practical regulatory rules or guidelines, strengthen consumer rights protection, advocate honest operation, and jointly create a good business environment. Next time, when you see the glamorous "boutique dine in restaurants" and "internet famous stores" on the platform, I suggest you keep your eyes open, carefully distinguish and make rational judgments, and not be easily blinded by the "AI illusion".
