Recently, the People's Court of Leping City, Jiangxi Province concluded a case of selling counterfeit and inferior products, sentencing the defendant Zhang to 9 months in prison, imposing a fine of 80000 yuan, confiscating illegal gains of more than 120000 yuan, and bearing compensation of more than 1.28 million yuan for criminal incidental civil public interest litigation. It is reported that from June 2022 to December 2023, Zhang purchased frozen duck meat boards and processed them into "beef rolls" and "lamb rolls" in a rented house. They were sold to multiple supermarkets and wholesale stores for a total sales amount of over 120000 yuan. In order to sell the processed "beef and mutton rolls", Zhang also forged a business license, food production permit, and authorization letter. On January 16, 2024, during an inspection conducted by the local market supervision and administration bureau in conjunction with the public security bureau, 429 boxes of finished "beef rolls" and "lamb rolls" and 812 boxes of raw materials were seized and confiscated on site. Soon, Zhang voluntarily surrendered himself. After trial, the court found that the defendant Zhang knowingly imported frozen duck meat plates containing cow fat and sheep fat, and still falsely claimed to be "lamb rolls" and "beef rolls" for sale. After testing, the seized "beef rolls" and "lamb rolls" were found to contain more than 99.75% duck derived components, and his behavior constituted the crime of selling counterfeit and inferior products. Considering Zhang voluntarily surrendered and truthfully confessed to his crimes, returned nearly 70000 yuan of illegal gains, and voluntarily admitted guilt and punishment, the above judgment is made in accordance with the law. The judge reminds that integrity is the foundation of business, and businesses should not be blinded by interests.
