Dispute resolution, work-related injury medical subsidy finally received

Not many words, but it warms the hearts of everyone in the investigation team. This is not only a long delayed subsidy finally received, but also a road of rights protection that has lasted for many years, and the final result is achieved after the intervention and supervision of the procuratorial organs. In 2022, Liu was unfortunately injured during coal mining operations and was assessed as a Level 9 disability, which was recognized as a work-related injury. However, when he applied for a one-time work-related injury medical subsidy from the social security center, the center did not approve it for Liu and did not pay the one-time work-related injury medical subsidy. Helpless, Liu chose to file a lawsuit to protect his rights. The court ruling requires the social security center to fulfill its payment obligations. However, after the judgment came into effect, the social security center delayed in fulfilling it. The verdict has become a 'IOU', I am really at my wit's end. ”In April of this year, in the reception room of Xiangyuan County Procuratorate, Liu choked up and told the prosecutor. The pressure of life and the subsequent treatment costs of injuries have left Liu physically and mentally exhausted. When the prosecutor saw Liu's appeal materials, he keenly realized that this may not be an isolated phenomenon. After preliminary investigation, the hospital found that the social security center had to varying degrees failed to pay the one-time work-related injury medical subsidy to workers in accordance with the law, in full, and in a timely manner in multiple disputes over one-time work-related injury medical subsidies. The Xiangyuan County Procuratorate immediately established a special task force to retrieve data on the application, verification, and payment of one-time work-related injury medical subsidies from relevant units, review court judgment documents, and visit some injured workers. Finally, it was confirmed that there are 42 individuals in the county who meet the conditions for receiving one-time work-related injury medical subsidies but have not yet received them. The amount of insurance benefits involved exceeds 3 million yuan, and 4 of them have been ordered by the court to fulfill their payment obligations by the social security center. In order to promote substantive resolution of administrative disputes, the Xiangyuan County Procuratorate invited representatives of the human resources and social security departments and injured workers to hold a symposium, and issued prosecutorial suggestions to urge relevant departments to fulfill their duties in response to relevant issues. After the prosecutor's suggestion was issued, the court continued to monitor the progress of the payment of benefits to 42 injured workers. For employees who have complete materials and procedures and have been verified to meet the conditions, a "green channel" was coordinated and opened to complete the distribution of subsidies. At the same time, in response to the situation where the employer is unable to pay the work-related injury insurance premiums due to arrears, the hospital proactively contacted relevant departments to urge the employer to make up for the arrears and completely overcome the payment bottleneck. In July of this year, the Social Security Center replied in writing to the Xiangyuan County Procuratorate, stating that the situation of unpaid work-related injury insurance benefits has been reviewed one by one, and the insurance benefits of 42 work-related injury employees have been gradually classified and resolved. Now, Liu's foot injury is recovering and his life is gradually getting better. With the optimization of the social security payment process and the establishment of a normalized supervision mechanism, the distribution of work-related injury medical subsidies in the county has formed a closed-loop management of "application review payment feedback".
