Beijing Fangshan: Using the case as evidence, legally secure the 'home' for charging stations

On October 15th, the People's Court of Fangshan District, Beijing held a press conference to report on the trial of adjacent disputes related to the construction and management of new energy vehicle charging facilities in the village area, and released three typical cases. Several city level people's congress representatives and 20 village (community) legal experts attended the briefing. It is reported that the Fangshan District Court, based on extensive and in-depth grassroots research, consultation with representatives of various parties and social needs, has put forward feasible suggestions for related work and sent judicial suggestions to high-risk villages and towns to strengthen the construction and management of new energy vehicle charging facilities in the village area. The relevant departments attach great importance to it, hold a special meeting to study and solve the problem, and actively respond with letters. With the assistance of the Fangshan District Court, they have formulated and formed management documents such as the "Management Rules (Template) for the Installation and Use of Personal New Energy Vehicle Charging Facilities", "Flow Chart for the Installation and Use of Personal New Energy Vehicle Charging Facilities", and "Commitment Letter". Among the three cases reported at the meeting, the focus of the lawsuit was the non-compliance of charging stations with regulations, occupation of public parking spaces, and illegal parking and charging by the parties involved. The court reminds that adjacent rights holders of real estate should handle their adjacent relationships correctly in accordance with the principles of favorable production, convenient living, solidarity and mutual assistance, and fairness and reasonableness. Charging pile applicants should exercise their rights within a reasonable and legal scope, especially when installing facilities outside the yard, they should comply with public management norms; Neighbors should fulfill their obligation of tolerance when there is no substantial obstruction.
