After marrying Zhang, Ms. Li suffered from domestic violence from Zhang for many years. One day in May this year, due to family matters, Zhang once again abused Ms. Li, resulting in her rib fracture, which was identified as a second degree minor injury. After Ms. Li reported to the police, the public security organs took criminal detention measures against Zhang in accordance with the law. After the investigation of the case was completed, it was transferred to the Xinzheng City Procuratorate in Henan Province for examination and prosecution. After the case was accepted, the handling prosecutor immediately contacted Ms. Li to inquire about the situation. During the conversation, Ms. Li blushed and told the prosecutor that she longed for a divorce and a way out of the domestic violence quagmire as soon as possible, but was also worried that Zhang's sentencing would affect her child's education and employment. Therefore, Ms. Li voluntarily requested a lenient treatment for Zhang. At the same time, the prosecutor learned that Ms. Li did not have a fixed job and lacked financial support after the divorce, facing numerous difficulties in her life. We must punish illegal and criminal acts in accordance with the law, safeguard the rights and interests of victimized women, minimize the impact on children, and solve the actual living difficulties of victims. ”With such considerations in mind, the handling prosecutor began a lot of meticulous work: on the one hand, he communicated with Zhang three times, combined with similar domestic violence cases to clarify the illegality and harmfulness of domestic violence behavior, and prompted him to deeply realize his mistake, sincerely repent and apologize to Ms. Li; On the other hand, we will promote courts, women's federations and other units to assist Ms. Li in handling divorce procedures and provide support for her to break away from her unhappy marriage. In response to Ms. Li's living difficulties, the procuratorial organs have initiated a judicial assistance procedure and provided her with judicial assistance funds to alleviate her urgent needs. In order to hear opinions from all parties, the Xinzheng Procuratorate held a public hearing on the intentional injury case of Zhang. At the hearing, the prosecutor provided a detailed introduction to the facts, evidence, and proposed handling opinions of the case, and Ms. Li stated her demands and ideas. The staff of the Women's Federation severely criticized Zhang from the perspective of protecting women's rights and promised to continue providing life assistance and employment guidance for Ms. Li. The staff of the street office, based on their experience in community governance, hope that Zhang can take this as a warning and strictly restrain his behavior in the future. The hearing officer and lawyer had a thorough discussion on the application of the law and social impact, and from the perspective of resolving conflicts and protecting the rights and interests of minors, they believed that it would be more appropriate to not prosecute Zhang. In the end, the Xinzheng Procuratorate made a decision not to prosecute Zhang based on the facts, evidence, and opinions of all parties involved in the case. At the same time, the procuratorial organs, together with the Women's Federation and the street office, signed a commitment letter against domestic violence with Zhang, clearly requiring him not to commit any violent acts against Ms. Li and her family again, otherwise he will be held legally responsible according to law.
