Two departments issue announcement to address disorderly price competition

Price competition is one of the important ways of market competition. In order to regulate market price behavior, maintain a good market price order, and promote high-quality development, the National Development and Reform Commission and the State Administration for Market Regulation issued a notice on the governance of disorderly price competition and the maintenance of a good market price order on the 9th. The announcement points out that for goods and services that implement market regulated prices, operators should follow the principles of fairness, legality, and good faith in accordance with the Price Law of the People's Republic of China, based on production and operation costs and market supply and demand conditions, exercise independent pricing power in accordance with the law, consciously maintain market price order, and jointly create a fair and orderly competition market environment. According to the announcement, development and reform departments, as well as market supervision departments, should work together with industry regulatory authorities to strengthen policy promotion, remind operators to operate in accordance with the law and regulations, and improve product quality and service levels. Remind and warn operators suspected of disorderly price competition, requiring them to consciously regulate their price behavior and strictly abide by the bottom line of price competition. Pay special attention to operators who fail to regulate their pricing behavior after being reminded and warned. If necessary, conduct cost investigations and price supervision inspections. If any illegal or irregular pricing issues are found, they will be investigated and dealt with in accordance with the law. The announcement points out that operators should strictly abide by the provisions of the Tendering and Bidding Law of the People's Republic of China and the Implementation Regulations of the Tendering and Bidding Law of the People's Republic of China, consciously regulate their tendering and bidding behavior, and shall not bid with prices lower than cost to ensure the quality of products and services. Fair and moderate competition is conducive to promoting the survival of the fittest in the market and improving the efficiency of resource allocation. ”Liu Zhicheng, a researcher at the China Institute of Macroeconomics, stated that the announcement, based on current laws and regulations such as the Price Law and the Tendering and Bidding Law, puts forward clear requirements from the aspects of researching and evaluating industry average costs, issuing reminders and warnings, and strengthening regulatory enforcement, guiding enterprises to operate in accordance with the law and regulations, which will play an important role in governing disorderly price competition. In the view of Deng Zhou, a researcher at the Institute of Industrial Economics of the Chinese Academy of Social Sciences, in order to control disorderly price competition, the decisive role of the market in resource allocation should be fully utilized, and the role of the government should be better played. The urgent task is to regulate the market price order. In the long run, measures such as developing emerging industries according to local conditions, optimizing the environment for technological innovation, strengthening standard setting, and expanding the domestic consumer market should be taken to promote enterprises to break away from the traditional development path driven by investment and fundamentally build a more efficient and standardized market competition environment.
