800 million pieces of food and beverage supermarket data were 'crawled' away

Crawler "technology is an automated program that simulates browser behavior to send requests to target websites and efficiently crawls useful data from the obtained response data. Someone illegally used "web crawling" technology to crawl over 800 million pieces of restaurant supermarket data and map data, causing economic losses to the victimized companies. The Putuo District Procuratorate in Shanghai recently handled a case like this. In February 2023, a map software company discovered anomalies in its daily risk control monitoring: unknown users were continuously crawling geographic coordinate data from the database, stealing up to 1 million to 4 million records in a single day. In May of the same year, the company reported the case to the public security organs. After investigation, the public security organ found that the data of another Internet company was illegally crawled by the same means. Following the clues, in June of the same year, the public security organs successively arrested Li and Wu. After investigation, it was found that Li and Wu work for the same technology company, mainly collecting data and generating business reports before reselling them to customers. Due to the need for a large amount of data and the low efficiency of obtaining data through normal browsing, the two hired Chen, who is engaged in technical work, to write an interface for illegal data crawling, attempting to illegally crawl relevant data. In July 2023, Chen was arrested and brought to justice by the public security organs. Given the technical and professional nature of the case, the public security authorities have invited the Putuo District Procuratorate to intervene in accordance with the law and guide the investigation and evidence collection. The public security organ focuses on the functional identification of the parameter acquisition script and program found in the computer held by the suspect, and in combination with the confession and chat records of Chen and others, it defines the acquisition method, quantity and access times of various data. In June this year, the public security organs transferred Chen and three others to the Putuo District Procuratorate for examination and prosecution on suspicion of illegally obtaining computer information system data. "The two murdered companies have different ways of using data commercially, so the economic losses of the two companies cannot be measured using the same model." The undertaking prosecutor introduced that although the map software company can calculate economic losses by referring to the fair market inquiry price, the data involved in the case of another Internet company is a core business resource that cannot be sold, and it is difficult to directly assess the value. It can only calculate the loss of operating flow costs caused by data crawling by others, but the record has a short retention period and has been covered by new operating records. For this reason, the court chose to conduct supplementary investigation on its own, and reached a conclusion by asking the third-party identification agency that the time period of the crime could be based on other months of the Internet company, and compared and calculated the server traffic cost settlement standard and the average traffic price of single line data. After repeated inspections, the handling prosecutor ultimately determined that the actions of Chen and three others caused a total economic loss of over 50000 yuan to the two companies. After examination, the court believes that in this case, Chen only provided a paid "crawler" program and interface, specifically designed to evade system verification mechanisms. Li and Wu used the program provided by Chen to illegally crawl and obtain data stored, processed, or transmitted in computer information systems, forming an upstream downstream collaborative relationship. Therefore, Chen's behavior is more in line with the constitutive elements of the crime of providing intrusion into computer information system programs, and Li and Wu's behavior should be held criminally responsible for the crime of illegally obtaining computer information system data. After arriving at the case, all three voluntarily pleaded guilty and accepted punishment, and actively compensated for the losses suffered by the victimized company. In August of this year, the Putuo District Procuratorate lawfully prosecuted Chen and three others. Recently, the court sentenced the defendant Chen to three years in prison, suspended for three years, and fined 30000 yuan for the crime of providing intrusion into computer information system programs. The court sentenced the defendant Li to two years' imprisonment, suspended for two years, and fined 30000 yuan for the crime of illegally obtaining computer information system data; The defendant Wu was sentenced to six months' imprisonment, suspended for one year, and fined 10000 yuan.
