The Regulations on Housing Rental officially come into effect today to improve market rules and the rights and interests of all parties involved

Starting from September 15th, the "Regulations on Housing Rental" (hereinafter referred to as the "Regulations") officially came into effect. As the first administrative regulation in the field of housing rental, the Regulation strengthens the supervision and management of the housing rental market, regulates rental and leasing activities, housing rental enterprise behavior, and brokerage agency behavior, and protects the legitimate rights and interests of landlords and tenants. The interviewed experts generally believe that the implementation of the Regulations will effectively regulate the housing rental market and provide support for accelerating the establishment of a housing system that combines renting and purchasing. At the same time, the Regulation will also help activate housing rental consumption and play an important role in expanding domestic demand. Specifically, the Regulation regulates areas that are prone to transaction disputes during the leasing process, such as housing environment, deposits, and property information. For example, the Regulation explicitly states that non residential spaces such as kitchens, bathrooms, balconies, corridors, underground storage rooms, garages, etc. cannot be rented out separately for residential purposes. The Regulation also requires that before releasing housing information, housing rental brokerage agencies should verify and record the identity information and housing ownership information of the principal, conduct on-site inspections of the housing, sign a housing rental brokerage service contract with the principal, and prepare a housing condition statement. In addition, according to the Regulation, starting from September 15th, lessors shall, in accordance with regulations, file the housing lease contract with the property management department of the location of the leased housing through the housing lease management service platform and other means. Regarding the relevant regulations on the filing of housing rental contracts, there have been misunderstandings such as "landlord tax" in the market before. Regarding this, Yan Yuejin, Vice President of Shanghai E-house Real Estate Research Institute, stated that the Regulation itself does not involve adjustments to tax and fee policies. There is no mention of tax and fee content in the Regulations, nor is there any consideration of adding new taxes and fees. Yan Yuejin believes that the main purpose of including contracts in the record is to standardize leasing transactions and ensure that contracts are traceable. With a registered contract, it will be more convenient for tenants to obtain their residence permit and housing provident fund for rental purposes. Leasing registration is a prerequisite for promoting measures such as' equal rights for renting and purchasing '. ”Li Yujia, Chief Researcher of Guangdong Housing Policy Research Center, stated that tenants who enjoy public services such as children's education and housing security need to be included in the protection scope of the Regulations through filing, so that the management department can protect their rights and interests in accordance with the law. It is worth noting that the implementation of the Regulation not only brings new regulations to the housing rental market, but also puts forward new requirements for the supervision of the housing rental market. The person in charge of the Ministry of Housing and Urban Rural Development recently stated that in order to ensure the implementation of the Regulation, relevant parties will accelerate the improvement of supporting systems. The relevant departments of the State Council and local governments will promptly introduce relevant supporting regulations, further refine institutional measures, enhance the operability of the system, and ensure the implementation of the provisions of the Regulations. In order to implement the provisions of the Regulation and promote the high-quality development of the housing rental market, relevant departments in Beijing, Chengdu, Hefei and other places have clearly grasped the implementation work through training sessions and other forms. On September 12th, it was learned from the Beijing Municipal Commission of Housing and Urban Rural Development that Beijing recently organized a city wide training conference on housing rental business. The meeting mentioned that in the next step, the housing and construction departments of the city will use the "Regulations" as a work guide to create a safer, more stable, and comfortable rental environment for the general public, and help promote the stable, healthy, and high-quality development of the housing rental market in Beijing. The Chengdu Housing and Urban Construction Bureau issued a notice on August 27th to implement the "Regulations". The notice specifies that the housing and construction administrative departments of each district (city) and county should actively coordinate with relevant departments such as market supervision, public security organs, cyberspace, and urban management law enforcement, strengthen supervision and inspection of housing rental activities, improve the linkage law enforcement mechanism, and investigate and deal with illegal issues in accordance with laws and regulations. The Regulations establish a basic order, safeguard the legitimate rights and interests of parties involved in housing rental activities, and enable all parties in the rental market to benefit and achieve a win-win situation. ”Li Yujia stated that implementing full chain supervision of the leasing industry and improving market rules will help promote the stable development of leasing relationships and the leasing industry.
