Recently, the Intermediate People's Court of Heihe City, Heilongjiang Province issued the "Judicial Protection Order for Anti Japanese War Sites," clarifying the "Ten Prohibitions," aimed at protecting multiple anti Japanese war sites and relics discovered in previous cultural relic surveys. The revolutionary cultural relics with the theme of the Anti Japanese War left all over the country have witnessed the 14 years of painstaking struggle of the Chinese people and are of great historical value. In recent years, various regions and departments have adhered to the rule of law, and through improving legislation, strict law enforcement, impartial judiciary, and strengthening the promotion of the rule of law, have made every effort to protect revolutionary cultural relics during the War of Resistance Against Japan, promote the whole society to remember the history of the War of Resistance Against Japan, inherit the spirit of the War of Resistance Against Japan, and strengthen the spiritual roots of the Chinese nation. During the Anti Japanese War, the Northeast Anti Japanese United Army led by the CPC insisted on fighting in the mountains and rivers, leaving a large number of revolutionary relics. The Haozi Lake Secret Camp is located in the Hongshi National Forest Park in Jilin Province, and is an important base for the Anti Japanese United Army to retreat and hide in the deep mountains. During the Anti Japanese War, the 359th Brigade of the Eighth Route Army was stationed here, cultivating farmland and land, leaving behind a large number of red revolutionary historical sites. The People's Procuratorate of Baota District, Yan'an City, Shaanxi Province, has filed an administrative public interest lawsuit against the varying degrees of damage to the historical site of the 359th Brigade Revolution in Nanniwan and its failure to be included in the national protection scope. Various methods such as prosecutorial suggestions and public hearings have been adopted to leverage the advantages of integrated case handling and supervise the comprehensive and systematic protection of martyr tombs and revolutionary sites. Since April 2021, the procuratorial organs of Shaanxi Province have promoted the recognition of 19 cultural relics, determined the level of 25 cultural relics, and included 68 cultural relics in the list of revolutionary cultural relics through handling public interest litigation cases, giving new vitality to revolutionary sites under the protection of the rule of law. Zuoquan County, Shanxi Province is located in the hinterland of the Taihang Gorge. During the Anti Japanese War, more than 150 party, government, and military leaders, including the Northern Bureau of the Communist Party of China Central Committee and the headquarters of the Eighth Route Army, were stationed here. There are hundreds of revolutionary sites and relics in the area. The public security organs of Zuoquan County continue to increase the intensity of cultural relic safety inspections, conducting regular on-site inspections of fire, electricity, fire equipment, and surrounding environment, and guarding the red line, bottom line, and lifeline of cultural relic safety. The site of the Zunyi Conference, Bing'an Ancient Town, and Sidu Chishui Memorial Hall are red landmarks that carry the glorious revolutionary history of the Zunyi Revolutionary Base Area in Guizhou. The judicial administrative organs in Zunyi have established a legal service team, which clarifies rights and responsibilities, builds consensus, connects systems, and effectively activates the protection momentum of red resources through non litigation mediation, legal publicity, and reasoning and interpretation. At the same time, the legislative body is also taking active action. In November 2024, the Law on the Protection of Cultural Relics was revised to clearly stipulate: "People's governments at all levels should take measures to strengthen the protection of cultural relics related to major events, important conferences, important figures and the great spirit of the founding of the CPC in various historical periods." "This provides a legal basis for law enforcement and justice to protect the cultural relics of the Anti Japanese Revolution in accordance with the law. ”Han Wei, associate professor of the Department of Law at Northwestern Polytechnical University and researcher at the Shaanxi Gansu Ningxia Revolutionary Base History Research Association, said. Various regions have also introduced local regulations on the inheritance, promotion, protection, and utilization of revolutionary cultural relics or red resources, such as the "Regulations on the Protection and Inheritance of Red Culture in Shandong Province", "Regulations on the Protection and Utilization of Revolutionary Cultural Relics in Jiangxi Province", "Regulations on the Protection and Utilization of Revolutionary Cultural Relics in Shaanxi Province", "Regulations on the Protection and Utilization of Revolutionary Cultural Relics in Henan Province", etc., which further clarify the requirements for the protection and utilization of revolutionary cultural relics. Zhi Zhenfeng, a researcher at the Institute of Law of the Chinese Academy of Social Sciences, believes that in the context of comprehensively promoting the rule of law, the rule of law, with its systematic, normative, stable, and mandatory characteristics, provides a solid guarantee for the protection of revolutionary cultural relics and has become an important force in safeguarding red heritage and inheriting revolutionary culture. In his view, the rule of law is a crucial element in the protection of revolutionary cultural relics. For example, the revised Cultural Relics Protection Law has further strengthened the protection of revolutionary cultural relics and consolidated the legal basis for the protection of revolutionary cultural relics. At the same time, the rule of law provides a sustained and effective "rigid" institutional guarantee for the protection of revolutionary cultural relics. The rule of law constructs a diverse and collaborative protection pattern for the protection of revolutionary cultural relics. By regulating the behavior of all parties involved, clarifying the rights and obligations of government departments, cultural relics management units, and the general public in the protection of revolutionary cultural relics, and imposing severe sanctions on behaviors such as destruction and illegal occupation of cultural relics, an effective protection force can be formed. ”He said that the rule of law is an important means to resist historical nihilism. Zhi Zhenfeng suggests that currently, the protection of revolutionary cultural relics should be based on the new cultural mission of the new era and the practical needs of cultural relics protection, and establish more scientific and systematic legal norms and make more perfect institutional arrangements for the protection and utilization of revolutionary cultural relics. The first priority is to establish a scientific protection system for revolutionary cultural relics. We should adhere to the principle of "protection first, rescue first, rational utilization, and strengthened management", establish a comprehensive and multi-level scientific protection system, promote the standardization, institutionalization, and legalization of revolutionary cultural relics protection, and comprehensively improve the quality and level of revolutionary cultural relics protection. Improve the graded and classified protection mechanism. In addition to graded protection according to administrative levels, a graded list should also be established based on the historical value, degree of endangerment, and difficulty of protection of revolutionary cultural relics.
