2025-09-02

On the 1st, the Hong Kong SAR government signed a memorandum of understanding with the World Intellectual Property Organization (WIPO) regarding the "WIPO Lex Judgments" database, aimed at strengthening information sharing and building a closer and more knowledgeable global intellectual property community. This database provides free and publicly available judicial judgments related to important global intellectual property rights. According to the memorandum of understanding, Hong Kong will provide the database with guiding judgments from judicial institutions in the field of intellectual property, facilitating the international intellectual property community to obtain relevant judgments and showcasing the level of intellectual property justice in Hong Kong. The Financial Secretary of the Hong Kong Special Administrative Region, Paul Chan, pointed out in his speech at the signing ceremony that Hong Kong's participation in the database is of great significance. Under the "One Country, Two Systems" policy, Hong Kong is the only region in China that implements common law in both Chinese and English. It has gained widespread international recognition in intellectual property protection and is also an important location for resolving intellectual property disputes involving mainland and overseas parties. The judgments of Hong Kong courts provide important references for the international legal community. Chen Maobo stated that strengthening cooperation between Hong Kong and the World Intellectual Property Organization can not only enhance Hong Kong's role in international judicial precedent exchange, but also consolidate its position as a regional intellectual property trading center and legal service hub. By enhancing the transparency of Hong Kong's intellectual property system on a global scale, we can further strengthen the confidence of international enterprises and intellectual property owners in investing and conducting innovative activities in Hong Kong. Chief Justice of the High Court of Hong Kong, Poon Siu Chuen, stated in his speech that according to the Memorandum of Understanding, representative judgments of Hong Kong courts in the field of intellectual property will be available for review on the database. Hong Kong will continue to play an important role in providing more convenient access to intellectual property judgments, enhancing global understanding of judicial methods for the latest common legal issues, and promoting international cooperation in intellectual property.
