Recently, the "Management Measures for the Protection Red Line of Permanent Basic Farmland" (hereinafter referred to as the "Measures") were officially announced to the public. The Measures shall come into effect on October 1, 2025. According to relevant officials from the Regulations Department and the Farmland Protection Supervision Department of the Ministry of Natural Resources, the "Measures" implement the requirement of "adhering to the strictest farmland protection system", and make specific provisions for the delineation, control, protection, optimization and adjustment, and quality construction of permanent basic farmland, and strictly protect it in accordance with the law. At the same time, the establishment of a management mechanism for the "good in, bad out" of permanent basic farmland will be the focus. While adhering to the overall stability of the red line for the protection of permanent basic farmland and ensuring that the protection tasks determined by national spatial planning are not exceeded, the goal is to integrate and adjust, concentrate and connect, and improve quality. The situations, procedures, and rules that allow for optimization and adjustment have been clarified, taking into account the rigidity of farmland protection and the flexibility of agricultural production. One is to establish a system of permanent basic farmland reserve areas. The "Measures" for the first time clarify the relevant provisions of permanent basic farmland reserve areas at the departmental level, and clarify that the natural resources department at or above the county level, in conjunction with the agriculture and rural department, shall organize the delineation of permanent basic farmland reserve areas as the main source of supplementary allocation for major construction projects occupying permanent basic farmland and optimizing the adjustment of the protection red line of permanent basic farmland. The second is to establish a mechanism for optimizing and adjusting the protection red line of permanent basic farmland. The Measures stipulate the circumstances in which permanent basic farmland protection red lines can be optimized and adjusted, and clarify the basic procedures and relevant requirements. The third is to improve the specific rules for the occupation of permanent basic farmland by national key construction projects. The Measures strictly implement the provisions of the Land Management Law, and in combination with relevant national policies and management practices, refine the scope of key construction projects that require the occupation of permanent basic farmland to ensure the reasonable needs of economic development.
