Typical case of ecological environment damage compensation released by two departments involved in water and air pollution control

Today is the third National Ecological Day, and the Supreme People's Procuratorate and the Ministry of Ecology and Environment jointly released a batch of typical cases of ecological environment damage compensation and public interest litigation linkage. Typical cases include six cases in which the People's Procuratorate of Haidian District, Beijing supported the Haidian District Ecological Environment Bureau in carrying out ecological environment damage compensation for some units that exceeded their total and excessive emissions of air pollutants. These cases involve the treatment of tailings ponds, water pollution, hazardous waste, air pollution, and other issues that affect the production and life of the people. In January 2025, the Ministry of Ecology and Environment, together with the Supreme People's Procuratorate and 11 other units, issued the "Opinions on Several Specific Issues Concerning Deepening the Reform of the Ecological Environment Damage Compensation System", which specifically stipulated the connection between ecological environment damage compensation and public interest litigation. The release of this batch of typical cases aims to summarize the experience and practices of various regions in carrying out the integration of the two systems, play a demonstrative and leading role, guide procuratorial organs and ecological environment departments at all levels, consolidate stronger legal forces, and contribute to the construction of a beautiful China. Typical cases demonstrate that the procuratorial organs and ecological environment departments have effectively promoted the resolution of prominent ecological environment problems and continuously met the needs of the people for a better ecological environment. Three units in Haidian District, Beijing, including a university, a heating company, and a property management company, have exceeded their total and excessive emissions of boiler exhaust gas nitrogen oxides, which have had a negative impact on the control of PM2.5 pollution in autumn and winter and ozone pollution in summer. The Haidian District Procuratorate of Beijing supports the ecological environment department in carrying out ecological environment damage compensation, encouraging polluting enterprises to repair damaged ecological environments through alternative restoration methods such as technological upgrades, and assisting in the prevention and control of fine particulate air pollution in the Beijing Tianjin Hebei region. At the same time, the procuratorial organs and ecological environment departments adhere to a holistic perspective to promote the long-term effectiveness of ecological environment protection work. In the criminal incidental civil public interest lawsuit filed by the People's Procuratorate of Jingxing County, Hebei Province against Li et al. and Shandong Energy Co., Ltd. for environmental pollution, multiple illegal entities transported and illegally buried more than 6700 tons of waste sulfur paste to Jingxing County, Hebei Province, resulting in 31815.26 tons of soil pollution. The Jingxing County Procuratorate and the ecological environment department in Hebei Province have carried out synchronous work, recovering a total of 103 million yuan in related expenses for ecological environment damage disposal and restoration, repairing 16 acres of damaged land, and completing the covering and greening of all contaminated land, achieving the full chain governance goal of "professional disposal government claims judicial recovery ecological restoration". It is reported that from January 2024 to July 2025, procuratorial organs across the country handled a total of 86000 public interest lawsuits in the field of ecological environment and resource protection; More than 7500 public interest lawsuits have been filed, accounting for approximately 57.6% of all public interest litigation cases filed in various fields. From January 2018 to July 2025, ecological and environmental departments and other relevant departments in various regions handled about 56900 cases of ecological and environmental damage compensation, involving a compensation amount of about 33.4 billion yuan, promoting the restoration of a large number of damaged ecological environments.
