Unlicensed tobacco monopoly products courier becomes accomplice in mailing

To obtain illegal economic benefits and violate regulations by helping friends who illegally sell tobacco monopoly products to mail, becoming accomplices in the crime. Recently, after being prosecuted by the Chencang District Procuratorate of Baoji City, Shaanxi Province, the court sentenced the defendant Shen to four years and six months in prison and fined 30000 yuan for illegal business operations in the first instance; Li was sentenced to one year in prison, suspended for one year and six months, and fined 3000 yuan. From October 2023 to August 2024, Shen searched for out of town customers to sell tobacco through social media platforms without obtaining a tobacco monopoly license. After negotiating the price with the buyers, he used a WeChat payment code to receive payment and then sent the tobacco by express delivery. Shen's friend Li, as a courier, knew full well about the tobacco monopoly and the regulations prohibiting the delivery of tobacco and its products beyond the limit. However, he still took advantage of the convenience of operating his own courier network and used a false name to help Shen send parcels for sale. In late August 2024, the buyer was discovered by law enforcement agencies while selling tobacco in the market. After careful investigation, the public security organ locked the suspect through the information of the express delivery site. In September, Shen and Li were successively summoned by the public security organs and truthfully confessed to the criminal facts. The public security organs seized unsold tobacco, cigarette cutters and other items at Shen's residence. After investigation, Shen sold tobacco to multiple people, with an illegal business value of over 259000 yuan. Li helped send 963 tobacco express deliveries, making an illegal profit of 3000 yuan. In November 2024, the public security organs transferred the case to the Chencang District Procuratorate for examination and prosecution. After examination, the court found that Shen violated national regulations by illegally operating tobacco monopoly products, and Li's act of helping to mail tobacco was a key link in the illegal operation of tobacco monopoly products, and he was an accomplice to the crime of illegal operation. He should be held criminally responsible for the crime of illegal operation. In March 2025, the Chencang District Procuratorate prosecuted Shen and Li on suspicion of illegal business operations.
