The reporter learned that during the investigation, the procuratorial organs found that the use of e-commerce platforms to sell counterfeit and inferior goods has been repeatedly banned. Compared to traditional counterfeit sales crimes, using e-commerce channels to sell counterfeit and inferior goods has lower infringement costs, updated marketing models, more covert sales channels, and greater governance difficulties. In the case of Yuan and others producing and selling fake and inferior products and selling counterfeit registered trademarks handled by the procuratorial organs, Yuan purchased fertilizer granules that did not meet national standards, used someone else's trademark and packaging to package the fertilizer granules, and sold them to more than 10 provinces across the country through 9 online stores registered on a certain e-commerce platform, with a sales amount of more than 7 million yuan. The procuratorial organs also found that the problem of personal information leakage of citizens in the e-commerce field is particularly prominent during the investigation. The e-commerce industry involves communication, logistics, retail, Internet and other fields, and has a large amount of personal information of citizens. Driven by profit, some practitioners illegally obtain personal information and illegally sell or provide it. In the case of Cheng's infringement of citizens' personal information handled by the procuratorial organs, Cheng took advantage of his position in the e-commerce business department of a certain company to sell more than 300000 cross-border shopping order information obtained in his work to others multiple times. It is worth noting that some illegal elements use e-commerce live streaming platforms to exploit the public's difficulty in distinguishing the authenticity of live streaming products, carefully set up live streaming scripts, package cheap products, and carry out live streaming fraud under the pretext of "high price recycling", inducing consumers to make purchases. Consumers should remain vigilant about this. In the fraud case handled by the procuratorial organs, Du and Shi fabricated the identity of a top jewelry brand in South Africa as Chinese agents, forged authorization certificates and testing certificates, falsely claimed that the "three no" products sold in the live broadcast room were South African jewelry, and promised to "repurchase at a high price" after a certain period of time, and later delayed with "account reported" and "sudden illness". After the platform's money was received, they disappeared and registered a new store to continue the fraud. The live broadcast account changed its shell and was "reborn", seriously infringing on the rights and interests of consumers. It is reported that the procuratorial organs will adhere to their duties in accordance with the law, increase the punishment for crimes such as the production and sale of fake and inferior goods, infringement of citizens' personal information, fraud, etc., resolutely punish the illegal activities of e-commerce black and gray products, and assist in the governance of cyberspace; Improve mechanisms for information sharing with administrative law enforcement agencies, and strengthen the two-way connection between administrative law enforcement and criminal justice; Give full play to the prosecutorial function of public interest litigation and actively promote industry governance.
