Drugs not only endanger the physical and mental health of the people, but also pose a huge threat to national and social stability. In recent years, the problem of substitution and abuse of narcotic drugs has become more prominent. Some illegal individuals illegally sell narcotic drugs for profit, leading to the influx of narcotic drugs into the drug market. In a typical case of drug crimes recently released by the Supreme People's Court, the director of a public hospital illegally sold a large amount of narcotic drugs for profit and was severely punished according to law. The defendant Su, who has long served as the director of a public hospital, has the qualification to prescribe anesthetics and Class I psychotropic drugs. From January 2013 to December 2021, Su and, taking advantage of their positions, applied for 536180 tablets of pethidine hydrochloride tablets (Duromeprazole) from two pharmaceutical companies in the name of the hospital. Su Mouhe illegally profited by not storing the above-mentioned hydrochloride pethidine tablets in the hospital warehouse, but selling them at a markup without authorization. Except for some sold to cancer patients, the remaining approximately 380000 tablets were repeatedly sold to unemployed person Huang Mouying at a price of 1.5 to 7 yuan per tablet (co defendant, already sentenced), earning a cumulative profit of more than 1 million yuan. Later, Huang Mouying sold the hydrochloride pethidine tablets purchased from Su Mouhe at a markup to former drug offenders Yu Moulong and Shao Moulian (both defendants have been sentenced). The court held that the defendant Su and illegally sold piperidine hydrochloride tablets for profit, which led to their flow into the drug market, constituted the crime of drug trafficking. Su, knowing that a large amount of pethidine hydrochloride tablets were likely to be abused in society, still used his identity as the hospital director to purchase and illegally sell them in large quantities, obtaining huge profits. The crime lasted for a long time, occurred frequently, and was in large quantities, causing great social harm and being particularly serious. After the incident, Su and others extensively issued red prescriptions to combat malicious behaviors such as auditing and investigation. Accordingly, the defendant Su was sentenced to death with a two-year reprieve, deprived of political rights for life, and had all personal property confiscated in accordance with the law. According to the Supreme People's Court's explanation, pethidine hydrochloride, also known as dulantine, is a synthetic analgesic drug used clinically. Long term use can lead to dependence and may cause severe respiratory depression, endangering life. Therefore, it is a strictly controlled anesthetic drug in China. Pyridine hydrochloride has dual properties as a drug and a narcotic. Once it enters the illegal market, it will seriously endanger the health and safety of the people. The defendant in this case, Su, is the director of a hospital and has the right to prescribe narcotic drugs. He is familiar with the national regulations on the management of narcotic drugs and has a clearer understanding of the social harm caused by the abuse of pethidine hydrochloride tablets than ordinary people. However, in order to seek illegal benefits, he knowingly sold pethidine hydrochloride tablets to unemployed person Huang Mouying for a long time, multiple times, and in large quantities, allowing the drug to flow into the drug market. His behavior should be convicted and punished for drug trafficking according to law. The people's court sentenced Su to death with a two-year reprieve based on the facts, nature, circumstances, and degree of harm to society of his crime, demonstrating the stance of severely punishing such crimes.
