On June 9th, a woman posted on social media that she was playing drifting in a scenic area when she was injured in one eye with a high-pressure water gun, resulting in blindness at the time. The perpetrator has fled and is now posting to search for witnesses. At present, local cultural and tourism, public security and other departments have intervened in the investigation. The man involved has been found, claiming that the water gun he used was not an industrial high-pressure water gun, but a "toy" purchased in the scenic area. The local public security organs will conduct an appraisal of the involved water gun. Although the truth of the incident needs further investigation, the recurrence of the "water gun injury incident" has once again exposed the stubborn problem of public safety to the public. In 2021, a tourist was shot with a water gun while visiting Beijing Happy Valley, causing a perforated eardrum; In April of this year, someone was hit in the eye with a high-pressure water gun during the Xishuangbanna Water Splashing Festival in Yunnan... When the "toy" turned into a "weapon", we have to admit that "water gun injuries" may seem accidental, but they are actually man-made disasters. Why is this kind of sharp weapon capable of causing harm rampant in crowded scenic spots and frequently causing trouble? Firstly, it reflects the weak supervision before the incident. On the one hand, the loss of control at the source has resulted in some commercially available water guns with astonishing destructive power remaining unobstructed. As a common multifunctional tool, high-pressure water guns should be used for vehicle cleaning, food processing, fire extinguishing, and other scenarios. However, the market is filled with a large number of water gun products labeled as "toys" that can spray high-pressure water jets. According to the Product Quality Law, regardless of whether there are national or industry standards, industrial products that may endanger human health and personal and property safety must meet the requirements for safeguarding human health and personal and property safety. On the other hand, if the entrance is overlooked, the ban on scenic spots has become a "paper tiger". The Tourism Law explicitly requires that scenic spots should have "necessary safety facilities and systems, undergo safety risk assessment, and meet safety conditions" when opened. Although many scenic spots repeatedly broadcast reminders to tourists to "prohibit carrying high-pressure water guns", they have fallen behind in the implementation process. High pressure water guns can easily break through the ban and even "infiltrate" scenic spots, which is equivalent to putting "no carrying flammable materials" slogans next to gunpowder barrels without setting up defenses against flammable materials. The safety commitment of scenic spots cannot be fulfilled. In addition to the lack of regulation, the "softness" and "slowness" of legal punishment have also contributed to the vicious cycle of "not learning from lessons". Some "gun wielding" assailants knowingly commit crimes, among which there are low-cost expectations due to insufficient legal deterrence. In practice, such incidents of injury are often classified as civil disputes or minor public security cases, with shallow and soft handling being the most common, and the legal deterrence is obviously insufficient. Therefore, it is necessary to prevent the illegal carrying of high-pressure water guns into scenic spots, and increasing the cost of illegal activities can sound an alarm for the public. If the above-mentioned victims do indeed become blind as a result, the man involved is not simply liable for civil compensation, and his behavior may be suspected of intentional injury. For those who maliciously use water guns to harm others, only by making them pay a painful price can we curb the impulse to play and cause harm, and also bring strong deterrence to the public. Every 'fire' of a water gun is a great challenge to public safety. Can high-pressure water guns that pose a threat to personal safety be completely prohibited from entering the scenic area? Is there a safer and more controllable alternative to meet the recreational needs of tourists? The water of joy turning into tears of pain once again reminds us that only by drawing a more rigorous boundary between "toys" and "weapons" and keeping "fake toys and real weapons" away from daily life can we provide the public with a safe and worry free playing space.
