The math genius who is not good at words was forced to open an account and walk to the camera to correct the situation. This is not only Wei Dongyi's personal helplessness, but also a microcosm of the urgent need for regulation in the entire online ecosystem. In recent years, some private life clips of public figures have been arbitrarily filmed, and after being manipulated and maliciously interpreted, uploaded to online platforms for spreading rumors, defamation, or monetization. Many victims face numerous difficulties in their rights protection journey: they choose to file complaints with the platform, but progress is slow and may even sink into obscurity; Choosing litigation is time-consuming, labor-intensive, and costly; Even if the perpetrator is banned, sometimes changing their "vest" or platform can bring them back to life with full health. The online environment needs to be purified, and individual rights and interests should be protected. To solve this problem, three paths can be taken simultaneously - in terms of law, to build a strong protective net for the "digital personality". The existing laws and regulations on the recognition standards and punishment intensity of infringement of online personality rights lag behind the rapid development of new technologies to a certain extent. Suggest that the legislative department improve legislation, and the judicial authorities explore the issuance of judicial interpretations for new forms of infringement such as deep forgery, accelerate the identification of infringement behavior, and increase the punishment for infringers; Simplify the process of electronic evidence identification, establish an online litigation zone, and effectively reduce the threshold for safeguarding rights; Clarify the joint and several liability boundaries of the platform in pre prevention, in-process disposal, and post accountability, providing clear legal basis for the platform to perform its duties. On the platform side, we will solidify responsibility and reshape algorithmic ethics. We should actively optimize the recommendation mechanism and establish "positive weighted recommendations" for positive characters and events, making high-quality content more accessible to the audience; By enhancing automatic recognition capabilities through technology, precise identification, synchronous flow restriction, and rapid removal of infringing videos such as secret filming and malicious splicing can be implemented, significantly reducing their exposure and dissemination range; Establish a fast response channel for complaints and compress the survival space of infringing content; Strictly implement the real name system and credit punishment, explore the implementation of the "cross platform joint punishment" mechanism, increase the cost of illegal and irregular activities, and cut off the "shell replacement and rebirth" chain. In terms of society, further enhance public media literacy. In the era of new media, everyone holds a microphone and can be a disseminator, but freedom of speech does not mean speaking without restraint. Therefore, it is necessary to strengthen legal publicity and education, cultivate the ability and level to identify the authenticity of information, improve rational expression, promote public active participation in the reporting of harmful information, and jointly maintain a good online environment. Only by establishing rules through the rule of law, actively fulfilling responsibilities through platforms, and building a foundation of civic literacy can we reverse the dilemma of being forced to open accounts and restore a clear space in cyberspace.
