Li Gang appealed and on February 28th of this year, the second instance judgment upheld the original verdict. In February 2023, Zhang Qiang (pseudonym) resigned from Shanghai and returned to Nantong, searching for a job while submitting his resume. After not finding a job for a while, Zhang Qiang realized that he had a car under his name and decided to start earning money by using ride hailing services. To become a ride hailing driver, you need to register online. When registering on a certain ride hailing platform, Zhang Qiang's driver identity was quickly approved, but the vehicle was prompted that the age limit had expired and the registration failed. At the moment when Zhang Qiang was discouraged, a "turning point" appeared. While browsing a short video, he saw someone advertise claiming that "registering a ride hailing driver can be done all at once". Zhang Qiang immediately contacted the other party and added them on WeChat. As requested by the other party, Zhang Qiang paid a "registration service fee" of 550 yuan and took photos of his driving license to send over. A few days later, Zhang Qiang received a photo from the other party, and the registration date on the document had been modified. Zhang Qiang successfully registered on the platform using this photo and started driving a ride hailing service. Zhang Qiang's situation is not an isolated case. Fan from Huaibei, Anhui, did not meet the required driving experience and drove a ride hailing service after paying a registration service fee of 500 yuan; Mr. Cheng from Quzhou, Zhejiang, lacked a ride hailing driver qualification certificate and was able to get on the road after paying 900 yuan... In February 2023, a safety inspector from a ride hailing company discovered that someone had posted an advertisement on their WeChat Moments, displaying "one-time registration for ride hailing" and "achievements". The inspector immediately reported the situation to the company, which reported it to the public security organs. "We found that Zhang Qiang bought a fake driving license, and then uploaded the photos of the fake driving license to the online car hailing platform..." On August 8, 2023, the suspect Li Gang (a pseudonym) was captured by the public security organ. 31 year old Li Gang, who acts as a "scalper" for ride hailing services, comes from Datong, Shanxi. He started running ride hailing services in 2018 and was later reported by customers for violating regulations, resulting in his account being banned by the platform. Later, Li Gang saw an advertisement online claiming to help drivers solve various ride hailing problems, including account suspension. After spending 500 yuan, Li Gang's account was unlocked and he resumed accepting orders for sports cars. Since then, Li Gang will introduce other online ride hailing car owners with demand to "scalpers" and earn information fees from them. Slowly, Li Gang gained a deeper understanding of the ways in which online ride hailing "scalpers" make money: they modify the information on their ID photos through photo editing software, upload them to the ride hailing platform for review, and in other words, make fake certificates. Despite knowing it was illegal, Li Gang still decided to become a "scalper" and take orders to earn money on his own. To this end, Li Gang diligently studied techniques online and downloaded image editing software for operation. In the second half of 2022, when Li Gang saw his "great achievement", he began to publish advertisements on WeChat groups and Tiktok, saying that it could help solve the problems of over age and under age of online car hailing. Soon, Li Gang received his first order, charging 200 yuan to help a person named "Little Male God" forge a driver's license photo and upload it to a ride hailing platform to pass the driving experience review. This' little male god 'later became Li Gang's' downline'. Li Gang quoted a price to the "little male god" and asked him to develop clients and demand service fees, and share the profits together. Li Gang has developed six or seven "downlines" similar to the "little male god", and the customer resources they provide keep Li Gang taking orders. During this time, Li Gang also met several "scalpers" through the internet, and customer resources were exchanged. According to statistics, from September 2022 to August 2023, the defendants Li Gang and six others forged, altered, bought and sold a total of 77 government documents and identity documents, including 15 motor vehicle driving licenses, 23 motor vehicle driving licenses, 34 online ride hailing qualification certificates, and 5 motor vehicle transportation certificates. The rule of law thinking guides the healthy development of the ride hailing industry. "Ride hailing is an emerging industry and a reflection of new quality productivity in transportation and travel. After the incident, due to the involvement of non-specific public travel safety, the prosecutor's office dispatched personnel to intervene in the investigation activities in advance, providing detailed guidance and investigation opinions on the ways of forging fake certificates, types of fake certificates, personnel involved, and evidence collection standards, clarifying the scope of the crackdown. Six individuals, including Li Gang and intermediary Deng, who directly committed the crime, were investigated, and those who only used the documents for personal purposes and had a small number of documents involved were not treated as crimes. In September 2024, the People's Procuratorate of Chongchuan District, Nantong City, prosecuted Li Gang and others for the crimes of forging, buying and selling state organ documents, and forging, buying and selling identity documents. At the same time, the procuratorial organs have turned their attention to the social governance of the ride hailing industry. The prosecutor learned that the Ministry of Transport issued the "Interim Measures for the Management of Online Reservation Taxi Operation Services" in 2016, which stipulates that drivers engaged in online ride hailing services should obtain a driver's license and have more than 3 years of driving experience, and vehicles intended to engage in online ride hailing operations should be under 8 years old. In this case, the falsification of documents mainly revolves around the age of the driver's license and the age of the vehicle. The prosecutor even found that there were cases in other places where people whose driver's license was revoked due to drunk driving successfully registered on the platform by making fake documents. In the case, the procuratorial organs transferred 67 "fake drivers" to ride hailing companies, supervised their implementation of safety responsibilities, checked clues one by one, and banned driver accounts that did not meet the registration conditions. It is necessary to carry out identity verification and qualification review for ride hailing drivers. ”On September 25, 2024, the procuratorial organs invited relevant departments to discuss comprehensive measures for the management of ride hailing services. For the practice of modifying the age limit through fraud, the procuratorial organs suggest that the competent department upgrade the platform warning mechanism, and through "warning rectification verification punishment", urge the platform to actively clean up illegal vehicles. What should I do if someone with a criminal record joins the ride hailing team? The procuratorial organs suggest that the public security organs carry out substantive criminal record review to fundamentally eliminate loopholes in criminal record fraud. The representative of the ride hailing company stated that they will rely on the public security department to increase the initial data review and verification efforts, change the certificate upload mode from "taking photos" to "recording videos", and strengthen daily inspections. If any abnormalities are found, they will be immediately responded to and dealt with. According to the head of the security department of the ride hailing company mentioned above, the number of abnormal ride hailing applications has significantly decreased, and the number of ride hailing drivers in the company has steadily increased.
