On May 22, at the fifth anniversary of the promulgation of the Civil Code held in Hangzhou, Zhejiang Province, Sun Ying, Deputy Prosecutor General of the People's Procuratorate of Zhejiang Province, introduced that since the implementation of the Civil Code in 2021, Zhejiang has handled a total of 49000 civil prosecutorial supervision cases, proposed supervision in 34000 cases, and obtained court changes or adoption in 33500 cases. The Civil Code is a fundamental and comprehensive law in the civil field, which establishes relatively complete predictable, trustworthy, and enforceable rules for the normal operation and healthy development of the economy and society. Zhejiang is a major economic province, guided by the principle of equality in the Civil Code. The procuratorial organs of the province protect the legitimate rights and interests of various market entities equally in accordance with the law in handling cases. Since 2021, more than 11000 civil procuratorial supervision cases involving enterprises have been handled, and more than 7300 cases have been put forward for supervision, recovering nearly 3 billion yuan in losses for enterprises. We will strengthen the handling of disputes related to property rights, creditor's rights, intellectual property rights, and other corporate disputes, highlight the supervision of corporate execution activities and bankruptcy trial procedures, and stabilize the expectation of corporate rule of law. ”Sun Ying gave an example that in the special supervision of the implementation of credit punishment measures for enterprises, the Zhejiang procuratorial organs put forward 837 prosecutorial suggestions to help 1079 enterprises and their operators repair their credit. Focusing on key hot areas such as housing, spousal debt, and worker protection, the Zhejiang procuratorial organs adhere to the principle of fairness in the Civil Code and safeguard people's livelihoods and interests. The People's Procuratorate of Longwan District, Wenzhou City, established a digital supervision model to investigate the issue of one party's newly generated loan being mistakenly identified as a joint debt of the couple. After investigation, seven suggestions for retrial and prosecution were submitted to the court, all of which were adopted. As a legal supervisory authority, the procuratorial organs, after the implementation of the Civil Code, clarify the application of law and achieve normative guidance through the supervision of effective civil judgments. We pay attention to innovative and leading provisions in the Civil Code and its judicial interpretations, as well as provisions that differ from previous separate civil laws, and review civil effective judgment supervision cases involving contracts, infringement disputes, etc. in accordance with the law. ”Sun Ying introduced that since 2021, more than 5400 cases of civil effective judgments with errors have been supervised in Zhejiang, and the court's change rate has reached 95%. At the same time, in response to procedural issues such as improper retroactive application of civil disputes that occurred before the implementation of the Civil Code and errors in the citation of judicial provisions, the Zhejiang procuratorial organs have also carried out similar case supervision. According to the provisions and relevant spirit of the Civil Code on the protection of special groups such as the elderly, women, and disabled, since 2021, the procuratorial organs in Zhejiang have filed 2718 cases of support lawsuits against elderly people with weak litigation ability, migrant workers seeking salary, disabled people safeguarding their rights, and women who have been subjected to domestic violence for divorce.
