Claiming to have a bomb, causing flight delay, sentenced
2025-05-19
In recent years, the safety of key transportation hubs has always been a concern for the public's nerves. What legal consequences will passengers face if they fabricate false terrorist information? The answer is given by a case that occurred at an airport in Hangzhou, Zhejiang. In November 2024, Zeng boarded a flight in Hangzhou. After the plane entered the takeoff and taxiing phase, he disregarded the advice of the flight attendants and forcibly requested to disembark. After being refused, he falsely claimed that there was a bomb hidden in his carry on luggage, which immediately caused a riot among passengers in the cabin. The crew immediately initiated emergency procedures to interrupt the flight, and the airport simultaneously launched a Level III emergency rescue response. More than 40 personnel including public security, armed police, and firefighters were deployed for disposal. After a comprehensive investigation and confirmation that it was a false alarm, the flight has been delayed for nearly two hours, causing direct economic losses of more than 7000 yuan. Aircraft, as a special enclosed space, any false security threat will trigger the highest level of emergency response, causing significant economic losses and endangering public safety and order. According to Article 291-1 of the Criminal Law, those who fabricate false terrorist information such as explosion threats and seriously disrupt social order shall be sentenced to fixed-term imprisonment of not more than five years, detention or surveillance. After the investigation by the public security organs was completed and transferred for review and prosecution, the People's Procuratorate of Xiaoshan District, Hangzhou City found that Zeng had engaged in drinking behavior before boarding the plane. In order to vent his emotions, he fabricated false and terrifying information, subjectively with the intention of disrupting public order, and objectively seriously disrupting the order of air transportation. The procuratorial organ believes that he should be held criminally responsible for fabricating false terrorist information. After the court's trial, it adopted the sentencing recommendation of the procuratorate and sentenced Zeng to six months in prison with a one-year probation for the crime of fabricating false terrorist information. Aviation safety is related to social stability. Publicly disseminating false terrorist information to unspecified individuals in public places not only seriously disrupts the normal operation order of civil aviation, but also undermines the sense of stability and security of people's lives. The judicial authorities will always maintain a high-pressure situation and crack down severely on criminal acts that seriously disrupt aviation order. In response to the frequent illegal activities in the aviation industry, prosecutors remind passengers that if disputes arise during the flight, they can be resolved through legal channels such as complaints and mediation applications after landing. Extreme measures should not be taken to vent emotions, otherwise one will not only be listed on the civil aviation dishonesty list and trapped in the dilemma of "one impulse, lifelong restriction", but also face serious consequences of criminal punishment. Only by adhering to the legal bottom line can each passenger jointly safeguard the lifeline of aviation safety. (New Society)
