In order to thoroughly implement Xi Jinping Thought on the Rule of Law, comprehensively and accurately implement the judicial responsibility system, and simultaneously focus on business management, case management, and quality management, the Supreme People's Procuratorate has recently issued the "Regulations on the Inspection and Review of Case Quality in People's Procuratorates (Trial Implementation)".
It is understood that in 2017, the Supreme People's Procuratorate issued the "Regulations on the Review of Case Quality in People's Procuratorates (Trial Implementation)", which played a positive role in implementing the prosecutor's case-handling responsibility system and strengthening the supervision and management of prosecutors' judicial case-handling. In October 2024, the Supreme People's Procuratorate studied measures to strengthen and improve procuratorial management and reduce the burden on grassroots units, put forward the "one cancellation and three no-longers", promoted the "three managements" in a coordinated manner, and emphasized that "the starting points of procuratorial management are the inspection and review of case quality and the investigation and punishment of judicial responsibilities". In order to adapt to the new situation and changes, the Supreme People's Procuratorate revised the "Regulations on the Review of Case Quality in People's Procuratorates (Trial Implementation)" and issued the "Regulations on the Inspection and Review of Case Quality in People's Procuratorates (Trial Implementation)" (hereinafter referred to as the "Regulations").
The "Regulations" are an important measure to comprehensively implement the "three managements" and promote the combination of macro management and micro management. They clarify that under the "big management" pattern of procuratorial work, a "big inspection" system for case quality that combines case quality inspection and case quality review should be established. The "Regulations" emphasize that people's procuratorates at all levels should establish and improve the working mechanism of "inspecting every case". For each case handled, different subjects and levels should be explored to adopt different forms and focus on different aspects of case quality inspection and review methods, so as to promote the normalization and standardization of case quality inspection and review.
In terms of "case quality inspection", the "Regulations" clarify that the case quality inspection work is organized and implemented by the case-handling department and is a necessary procedure before the case is archived. The case-handling department can organize and carry out case quality inspection through methods such as special person inspection, cross-inspection, and key inspection according to the case type, applicable procedures, and complexity. It focuses on comprehensively inspecting the fact-finding, evidence admissibility, application of law, explanation of the law, and compliance with case-handling procedures.
In terms of "case quality review", the "Regulations" list six types of cases that should be reviewed with key focus on a case-by-case basis. Compared with the original review regulations, the fields of civil procuratorial work, administrative procuratorial work, and public interest litigation procuratorial work have been added, achieving full coverage of the "four major procuratorial works".
In terms of the connection between case quality inspection and review work, the "Regulations" clarify that for cases that should be reviewed with key focus on a case-by-case basis and cases that have already undergone case quality review, the case-handling department may no longer conduct quality inspection. It also points out that when the case-handling department has promptly corrected and rectified the problems found in the case quality inspection, it should be comprehensively considered when determining the evaluation grade.
In terms of the application of the results of case quality inspection and review, the "Regulations" clarify that if it is found that the case-handling personnel may have behaviors that violate procuratorial duties and need to be held accountable for judicial responsibilities, they should be transferred to the department responsible for procuratorial supervision within the procuratorate for handling in accordance with relevant regulations. For cases rated as unqualified, if the personnel who should bear judicial responsibilities are determined by relevant departments in accordance with the procedures, this situation should be used as an important reference for individual assessment. At the same time, it is clearly stated that for excellent legal documents, typical cases found in the review, as well as units and individuals with outstanding case-handling achievements, the case-handling units, political work and personnel departments, etc. can give commendations and rewards in accordance with relevant regulations.
