The People's Court's Sixth Five Year Plan for Reform has been released, with over 200 specific reform tasks identified

The Supreme People's Court held a press conference today to release the "Outline of the Sixth Five Year Reform of the People's Courts" (hereinafter referred to as the "Outline"), which was officially issued and implemented on December 26th. The Outline consists of three main parts: overall requirements, main tasks, and organizational implementation. Among them, the overall requirements include guiding ideology, basic principles, and overall goals. The main tasks include 9 aspects and 45 items. The organization and implementation put forward requirements for strengthening organizational leadership, enhancing subject responsibility, orderly exploration and innovation, and strengthening evaluation and effectiveness. According to Mao Zhonghua, Vice President of the Supreme People's Court, the 45 major reform contents identified in the Outline will be further subdivided into more than 200 specific reform tasks, and the main content, responsible parties, completion time limits, and results forms of each task will be clarified for project-based and ledger based management. The Outline puts forward the overall goal of deepening reform: by 2028, the system and mechanism of judicial power operation, institutional function setting, judicial resource allocation, team capacity building and other aspects will be more perfect, judicial quality, efficiency and credibility will be effectively improved, people's courts will safeguard national security and social stability, maintain social fairness and justice, and safeguard the national legal system's unity, dignity and authority. The role of serving high-quality economic and social development, promoting the modernization of national and social governance, and ensuring the smooth progress of Chinese path to modernization will be more prominent, people's sense of gain, happiness, and security will be further enhanced, and the socialist judicial system of fairness, efficiency, and authority will be more mature and finalized. The reporter noticed that during the research process, prominent contradictions between people and cases in courts across the country, difficulties in resolving disputes, unscientific trial management systems and mechanisms, imperfect court organizational systems and institutional settings, urgent optimization of judicial resource allocation, and challenges to the stability and development of the court team were identified. The "Outline" responded to these prominent issues one by one, comprehensively and systematically proposing various reform measures to promote the resolution of difficulties, fill gaps, strengthen and weaken areas, and promote development. In order to fully protect the litigants' litigation rights, the Outline proposes to "consolidate and deepen the case registration system, adhere to the principle of voluntary mediation, and protect the litigants' litigation rights in accordance with the law when it can be adjusted and when it is judged", effectively eliminate the phenomenon of pre litigation mediation against the wishes of the litigants, long mediation, delay in filing, and effectively prevent "difficulty in filing a case". For the issue of protecting minors that is widely concerned in society, the "Outline" proposes to "implement systems such as reminders for caring for minors, social surveys, and social observation" and "improve the linkage and coordination mechanism between judicial protection of minors and family protection, school protection, social protection, network protection, and government protection". Mao Zhonghua said that this is to reform and improve the juvenile trial work from the system and mechanism level, optimize the trial methods and supporting systems of juvenile cases, and promote more comprehensive protection of minors.
