Shaanxi court collaborates with public security to crack down on crime of refusing to execute

Recently, the Shaanxi Provincial High People's Court, in conjunction with the Provincial Procuratorate and the Provincial Public Security Department, issued a notice to launch a one-year concentrated crackdown on criminal acts of refusing to execute judgments and rulings throughout the province from September 1, 2024. The notice specifies 14 specific situations in which the subject responsible for the execution obligation, such as the executed person, the person assisting in the execution obligation, and the execution guarantor, may be held criminally responsible in accordance with the law; Explicitly inciting and assisting debtors to evade execution, obstruct execution, resist execution, and other behaviors will also be dealt with seriously in accordance with the law and regulations. Those who constitute a crime will be held criminally responsible in accordance with the law; Urge all persons subject to enforcement who have filed for enforcement in the third level courts within the province but have not fulfilled their obligations as determined by the effective legal documents to voluntarily and promptly report their assets to the enforcement court and fulfill their obligations truthfully; Call on the general public, especially the applicants for enforcement, to actively support and assist the judicial organs in cracking down on the crime of refusing enforcement in accordance with the law, jointly maintaining social order, and publicize the reporting hotline. In addition, in order to further consolidate and improve the normalized mechanism for cracking down on refusal to execute crimes by public security, procuratorial, and judicial organs, Shaanxi Higher People's Court, together with the procuratorate and the public security department, has issued implementation rules for further improving the normalized mechanism for punishing refusal to execute judgments and rulings in accordance with the law. The case handling process has been improved from the aspects of case jurisdiction, transfer, filing and investigation, examination and prosecution, and trial in accordance with the law, and the judgment criteria for "capable execution", "refusal to execute", "serious circumstances" and other situations have been unified, clarifying the content of the normalized mechanism for cracking down on refusal to execute crimes.
