Recently, the China National Intellectual Property Administration, together with the Central Propaganda Department, the Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security, the Ministry of Justice, the Ministry of Commerce, the General Administration of Customs, the State Market Supervision and Administration and other eight departments, jointly issued the Implementation Plan for the Construction of the Intellectual Property Protection System (hereinafter referred to as the Implementation Plan). On May 28, the China National Intellectual Property Administration, together with the Supreme People's Court, the Supreme People's Procuratorate and the State Administration of Market Supervision and Administration, held a press conference to interpret the Implementation Plan and introduce the latest progress in intellectual property protection. The Implementation Plan proposes that by 2035, the modernization of the intellectual property protection system and protection capacity will be basically achieved, forming a modern intellectual property protection governance system where the government fulfills its responsibilities, law enforcement departments strictly supervise, judicial organs impartially administer justice, business entities regulate management, industry organizations self discipline and autonomy, and the public is trustworthy and law-abiding. The Implementation Plan emphasizes the improvement of the intellectual property prosecution mechanism and the deepening of the comprehensive performance of intellectual property prosecutors. Intensify the supervision of intellectual property civil and administrative litigation, continue to promote the punishment of malicious litigation, and steadily explore public interest litigation in intellectual property prosecution. The relevant person in charge of the Intellectual Property Prosecution Office of the Supreme People's Procuratorate, in response to questions from reporters at today's press conference, introduced the achievements of the Supreme People's Procuratorate in organizing special supervision to punish malicious intellectual property lawsuits since July 2022, as well as typical cases handled in the fields of patents, trademarks, copyrights, etc. He stated that in the next step, the procuratorial organs will carry out special work on a regular basis, strengthen overall coordination and promotion, continue to dig deep into case clues, establish and improve long-term mechanisms for preventing and combating malicious intellectual property litigation, improve the sharing mechanism of law enforcement and judicial information, and work together to promote industry governance, comprehensive governance, and source of litigation governance.
